RESOLUTION NO. 2010-01-06
RESOLUTION TO NOT RENEW A COMMERCIAL AND INDUSTRIAL SOLID WASTE
COLLECTION AND DISPOSAL CONTRACT WrrH WASTE MANAGEMENT OF
"rEXAS, INC.
WHEREAS, the City Council of the City of Anna, Texas (City Council) approved a Solid
Waste Collection and Disposal Contract (Contract) with Waste Management of Texas,
Inc. (Waste Management) with an effective date of August 1, 2005; and,
WHEREAS, the term of service stipulated in the Contract is for five (5) years, with one
(1) five-year renewal option pending agreement of both parties; and,
WHEREAS, should either the City or Waste Management elect not to renew and extend
the Contract for an additional five year period, notice must be given, by certified mail
(retum receipt requested) to the other party in writing not less than 90 days prior to the
expiration of the Contract; and,
WHEREAS, the City Council has determined that it is in the best interests of the City of
Anna to not renew and extend the Contract for an additional five year period:
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS ·rHAT:
Section 1. Recitals Incorporated
The recitals set forth above are incorporated herein for all purposes as if set forth in full.
Section 2. The City Council hereby directs the City Manager to provide written notice
by certified mail (retum receipt requested) to Waste Management not less than 90 days
prior to the expiration of the Contract that the City of Anna is not electing to renew and
extend the current Contract for an additional fIVe year period.
PASSED by the City Council of the City of Anna, Texas, on this 26th day of January,
2010.
