RESOLUTION NO. 2010-02-04
RESOLUTION BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS ACCEPTING THE
COMPLETION OF PHASE II OF THE THROCKMORTON CREEKITRINITY RIVER SEWER
INTERCEPTOR PROJECT
WHEREAS, the Cities of Anna and Melissa have entered into Contracts for Water Supply and
Sewer Service with the Greater Texoma Utility Authority; and
WHEREAS, the Greater Texoma utility Authority had entered into a contract with Four D
Construction Co., Inc. for the construction of Phase II of the Throckmorton CreekITrinity River
Sewer Interceptor project for the Cities of Anna and Melissa, Texas;
WHEREAS, Four D Construction Co., Inc. was unable to complete their responsibilities under the
provisions of the contract;
WHEREAS, the Greater Texoma Utility Authority subsequently assigned the unfinished portion of
Phase II of the Throckmorton CreekITrinity River Sewer Interceptor project to Wright Construction
Co., Inc.;
WHEREAS, the Greater Texoma utility Authority has entered into negotiations with Travelers,
Inc., the bonding company for Phase II and has successfully negotiated a settlement in the
amount of $134,499.92; and
WHEREAS, representatives of the Greater Texoma Utility Authority, the Cities of Anna and
Melissa and the consulting engineer have reviewed the facility constructed as Phase II of the
Throckmorton CreekITrinity River Sewer Interceptor project and found it to be complete,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS THAT:
Section 1. The recitals set forth above are incorporated herein for all purposes as if set forth
in full.
Section 2. The City Council hereby formally accepts the work for Phase II of the Throckmorton
CreekITrinity River Sewer Interceptor project as complete.
