RESOLUTION NO. 2010-07-04
A RESOLUTION OF THE CITY OF ANNA, TEXAS ALLOWING MEMBERS OF
ITS CITY COUNCIL TO SIMULTANEOUSLY SERVE AS A MEMBER OF THE
CITY FIRE DEPARTMENT IN A VOLUNTEER CAPACITY
WHEREAS, the City Council of the City of Anna, Texas ("City Council") recognizes that
volunteers make important contributions to the community; and
WHEREAS, the City Council encourages participation in both local government and
volunteer organizations that protect the community's health, safety and welfare; and
WHEREAS, Section 21.003 of the Texas Local Government Code allows a member of
a governmental body to simultaneously serve as a volunteer for an organization that
protects the health, safety and welfare of the municipality regardless of whether the
organization is funded or supported in whole or part by the municipality if the governing
body adopts a resolution allowing members of the governing body to perform service of
that nature;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Recitals Incorporated.
The above recitals are incorporated herein as if set forth in full for all purposes.
Section 2. Council Member may serve as volunteer of Fire Department.
The City's Fire Department protects the general health, safety and welfare of the City of
Anna, Texas rCity"). Any member of the City Council may serve as a member of the
City's Fire Department in a volunteer capacity provided that the City Council member is
otherwise qualified to serve in such capacity in accordance with any other applicable
law, City ordinance, or internal City policy. Any City Council member who becomes a
volunteer member of the City's Fire Department-whenever acting in said capacity
shall be subject to all applicable provisions of the City of Anna Personnel Policy Manual,
all internal policies of the Fire Department, the authority of those in the Fire
Department's chain of command, and the authority of the City Manager. At all times
such City Council member shall act in accordance with the City of Anna, Texas Home
Rule Charter, the City's codes or rules setting forth standards of ethics for public
officials, and all other laws and ordinances that prohibit conduct by a City Council
member including without limitation those related to interactions with City staff,
representation of groups before the City Council, conflicts of interest, exerting
authority/influence resulting in special treatment or benefits, or other conduct that
conflicts or interferes with the Fire Department's morale, chain of command, or the

authority or responsibilities of the Fire Chief or City Manager. A City Council member
who becomes a volunteer member of the City's Fire Department is subject to being
removed from the Fire Department in the same manner as any other volunteer member
of the Fire Department.
