RESOLUTION NO. 2013-06-03
A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING AND AUTHORIZING THE
CITY MANAGER TO ACT ON THE CITY'S BEHALF IN EXECUTING AND APPROVING
AN AMENDMENT TO CHANGE ORDER NO. 1 AND CHANGE ORDER NO. 2 TO THE
CONTRACT WITH QUALITY EXCAVATION, LTD. FOR THE FM 455 UTILITY
RELOCATION PROJECT.
WHEREAS, On April 23, 2013 the City Council of the City of Anna, Texas (the "City Council")
approved Change Order No. 1 and Change Order No. 2 to the FM 455 Utility Relocation
Project Contract, and;
WHEREAS, the amount for Change Order No. 1 was incorrectly calculated to be
$152,905.50, and;
WHEREAS, the actual amount for Change Order No. 1 is $157,265.50, and;
WHEREAS, the amount of Change Order No. 2 was correctly calculated and reported at
$69,829.25 and remains unchanged;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Recitals Incorporated.
The recitals above are incorporated herein as if set forth in full for all purposes.
Section 2. Approval of Amended Change Order No. 1 and Change Order No. 2.
The City Council hereby approves the amended Change Order No. 1 and Change Order
No. 2 to the contract with Quality Excavation, Ltd., attached hereto as Exhibit 1 and Exhibit
2 respectively; and authorizes, ratifies and approves the City Manager's execution of same.
The City Manager is hereby authorized to execute all documents and to take all other
actions necessary to finalize, act under, and enforce the Change Orders.
PASSED AND APPROVED by the City Council of the City of Anna, Texas, on this 25th day
of June, 2013.

Description of changes: Addition of valves, hydrants, fittings and connections of
water line.
Reason for Chane Order: Original TxDOT survey was an aerial survey and did not
pick up all existing valves and hydrants. Development also occurred since the
original survey was performed 7 years ago.

Description of changes: Relocation of approximately 900 feet of water line that is in
conflict with the proposed noise wall construction adjacent to the Oak Hollow
Subdivision.
Reason for Change Order: TxDOT is constructing a noise wall along the ROW
adjacent to the Oak Hollow subdivision as required by the environmental
documentation.
