HomeMy WebLinkAboutRes 2022-06-1195 Anna Retail Addition, Block A, Lots 1R, 3R, 6, 7, 8, 9 and Block B, Lot 1, Final PlatCITY OF ANNA, TEXAS A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING ANNA RETAIL ADDITION, BLOCK A, LOTS 1R, 3R, 6, 7, 8, 9 AND BLOCK B, LOT 1, FINAL PLAT WHEREAS, in order to provide for the orderly development of land within the Anna city limits and extraterritorial jurisdiction, the City Council of the City of Anna, Texas (the "City Council") has adopted Article 9.02 of the Anna City Code of Ordinances ("Subdivision Regulations"); and WHEREAS, Estate of Michael Pruitt —David Claassen (the "Applicant") has submitted an application for the approval of the Anna Retail Addition, Block A, Lots 1 R, 3R, 6, 7, 8, 9 and Block B, Lot 1, Final Plat (the "Property"); and WHEREAS, The Applicant requests a waiver from the following regulation located within the Subdivision Regulations and Design Standards of the City of Anna; • Minimum frontage on a public street. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS THAT: Section 1. Recitals Incorporated The recitals above are incorporated herein as if set forth in full for all purposes. Section 2. Conditional waiver of minimum frontage on a public street. (a) In granting the waiver as described, the City Council has examined the relevant evidence and finds that: 1. Granting the waiver will not be detrimental to the public safety, health or welfareI and will not be injurious to other property or to the owners of other property, and the waiver will not prevent the orderly subdivision of other property in the vicinity; ® The request is not detrimental to public health, safety, or welfare and does not prevent orderly subdivision of the surrounding properties. The property owner is proposing a 5046ot access easement that will connect future Throckmorton Boulevard to the existing access easement, acting as a private street. 2. The conditions upon which the request for awaiver/suspension are based is unique to the Property and are not applicable generally to other property; • This large tract of land has a unique shape due to the surrounding properties being platted prior to a regional or master plan. Creating Lot 9 as a separate lot, is in conformance with Sec. 9.02.087 (Lots) by not creating an irregular, severely elongated lot. 3. Because of the particular physical surroundings, shape and/or topographical conditions of the specific property involved, a particular undue hardship to the property owner would result, as distinguished from a mere inconvenience or increased expense, if the strict letter of these regulations is carried out; • This large tract of land has a unique shape due to the surrounding properties being platted prior to a regional or master plan. The access easement acts as a private street. If the access easement were required to be an improved street, the City would be required to own and maintain the road. 4. The waiver/suspension will not in any manner vary the provisions of the zoning ordinance, comprehensive plan (as amended), or any other adopted plan(s) or ordinance(s) of the city; • The waiver request is specific to one standard contained within the Subdivision Ordinance and Design Standards. Section 4. Approval of Minor Plat. The City Council hereby approves the Anna Retail Addition, Block A, Lots 1 R, 3R, 6, 7, 81 9 and Block B, Lot 1, Final Plat attached hereto as Exhibit A. We respectfully request that this Replat be approved with a waiver to the following requirements, Sec.9.02.087 (b) Minimum frontage on a public street. Each lot on a subdivision plat shall front onto a dedicated, improved public street, unless platted as an approved private street subdivision in accordance with these subdivision regulations. All lots shall have a minimum of 40 feet of frontage along the property line of a dedicated, improved street unless other provisions have been authorized under article 9.04 or an approved planned development district. This waiver is requested based on the following: Lot 9 of this Replat does not adjoin a dedicated ROW. However, the Lot has an existing improved 24 access easement on the plat which goes through the property on the north and on the west. In addition, another 24' access easement on the south of the Lot will be plated with this Final Replat. All of these platted access easements provide direct access to Central Expressway, Hwy. 455 and the future Throckmorton Drive. This is the only lot within this Final Replat that does not adjoin a dedicated ROW and it is because of the location being situated directly behind Loves.
