HomeMy WebLinkAboutCCmin2000-03-14City Council Minutes Anna High School Portable #9 March 14, 2000 The City Council of the City of Anna met in regular session on the 14"' day of March Item #1 Mayor Ron Ferguson called this meeting to order at 7:31 p.m.. Item #2 The following members were present and participating: Mayor Ron Ferguson, Joe Murphy, Joel Foltz, Duane Hayes and Bob Estep. Others present were Buck and Margaret Parks, Wade Huley, Johnny McBride, Val Mulder, Jackie Hunn, Forrest Smith, Pat Dillon, Lee Lawrence, Robert Sandlin, Keith Downing, Gator Larkin, Anthony Geer and Jon Hendricks. Item #3 Mayor Ferguson asked for citizen participation at this time. Wade Huley spoke to the council on his concerns about the new transmission lines that TUX Electric is planning. Item #4 Ashley Overbey was not present for the presentation titled Welcome to Anna. Item #5 Pat Dillon of Southwest Consultants informed the Council of the upcoming 200112002 TCDD Grant Application cycles. After some discussion a motion was made by Lisa Copeland to begin the public hearing process and investigate potential projects for which the City might apply; seconded by Joe Murphy. The motion carried 510/0. Item #6 The City Secretary reported to the Council that the City published an RFP notice in the McKinney Courier Gazette and mailed Return Receipt Requested RFP's to five qualified Planning Consultants. She also reported that one RFP Response for Planning Services was received. The Mayor opened the response from Southwest Consultants, Richardson TX. A motion was made by Duane Mayes that oNE RFP response was adequate and that the Council should proceed with selecting a Planning Consultant to complete the required planning activities for the TCDP Plan ninglCapacity Building Fund Grant; seconded by Lisa Copeland. The motion carried 51010. After some discussion, a motion was made by Duane Hayes that Southwest Consultants be selected as the City's first ranked choice to provide Planning Services under the 2000 TCDP Planning/Capacity Building Fund Grant; seconded by Lisa Copeland; The motion carried 51010. Item #7 After additional discussion, Duane Hayes made a motion that Southwest Consultants, Richardson, TX, be hired to provide Planning Services and complete the required planning activities for the 2000 Planning/Capacity Building Fund Project and that the Mayor is authorized to execute the contract, seconded by Lisa Copeland; the Mayor called for a vote. The motion carried 51010. The fee envelope was then opened and, Lisa made a motion that Southwest Consultant, Richardson, TX, be paid $27,300.00 (i.e., $23,800. TCDP Funds and $3,500.00 in LOCAL Funds). Duane Hayes seconded the motion; the Mayor called for a vote; the motion passed 51010. Item #8 After much discussion regarding the need for IMPACT 'Fees Lisa Copeland made a motion to proceed with the development of a contract with Southwest Consultants (SWC) for writing an IMPACT Fee Ordinanm that SWC will bill hourly until the council can meet and define the parameters needed for SWC to provide a firm consulting fee to the council for the services to be provided; seconded by Duane Hayes; the Mayor called for a vote; the motion carried 510/0. Item #3 There was no action taken on the fire hydrant meter bill relating to the Anna ISD Project. Item #10 Joe Murphy made a motion to grant the variance on the set back of the back property line for Mr. Smith to move the church building closer to the back of the lot to allow for more parking. Lisa Copeland seconded the motion. The motion carried 5/010. Item #11 The City Council met with the Hunn's to discuss and take action as needed on the approval of a mobile home outside the mobile home park. Bob Estep made a motion to grant a variance on the zoning regulations, allowing them to place a mobile home on their property. Joe Murphy seconded the motion. The motion carried 41110. Item #12 The City Council met with the Park's to discuss and take action as needed on the removal of their existing house and replacing it with a mobile home. Bob Estep made a motion to grant this variance on the zoning regulations. Joe Murphy seconded the motion. The motion carried 3/211. Item #13 The City Council spoke to Phyllis Clark regarding the road conditions on South Interurban Street. Duane Hayes made a motion to have the road oiled due to the health conditions of one of the residents that live on the road. Joe Murphy seconded the motion. The motion carried 5/010. Item #14 There was no action taken on the item relating to Chuck Burns water bill Item #15 There was no action taken on the electrical wiring and sheet rock variances for Tommy Cunningham. Item #16 Lisa Copeland made a motion to adopt a resolution of the City Council of the City of Anna; Texas to execute an interlocal agreement to continue participating in road and bridge maintenance/improvements projects within the corporate limits of Anna by and between the City of Anna, and Collin County, Joe Murphy seconded the motion. The motion carried 510/0. Item #17 The City Council held a public hearing on the annexation of a 136.4006 -acre tract owned by Robert H. Sandlin located at the north west corner of Highway 5 and County Road 371. There was no comments made. Item #18 Duane Hayes made a motion to accept the recommendations from the Planning and Zoning Board on the Annexation and the Preliminary Plat of Tara Farms without the impact fees and to require a prorated refund to the developer if others tie onto the water and sewer. Lisa Copeland seconded the motion. The motion carried 5/010. Item #19 Duane Hayes made a motion to authorize the Mayor to sign an agreement with the Westminster Water Cooperation on the CCM area. Lisa Copeland seconded the motion. The motion carried 51010. Item #20 Joe Murphy made a motion to authorize the Mayor to excute an agreement with the City of Melissa on the CCN area, city limit boundary's and the ETJ boundaries. Lisa Copeland seconded the motion. The motion carried 51010. Item #21 Duane Hayes made a motion to allow the revised bid specifications for the new backhoe to go out to bid. Lisa Copeland seconded the motion. The motion carried 51010. Bob Estep made a motion to allow the bid specifications for street repair to go out to bid. Joe Murphy seconded the motion. The motion carried 51010. Item #22 Duane Hayes made a motion to grant the partial release of the easement of a piece of property by Anna Lake Estate owned by Larry Busby Joe Murphy seconded the motion, The motion carried 51010. Item ##23 Duane Hayes made a motion to approve the minutues for February 8. 2000 and February 17, 2000. Lisa Copeland seconded the motion. The motion carried 51010. Item #24 Duane Hayes made a motion to approve the bills. Lisa Copeland seconded the motion. The motion carried 51010. Item #25 Garry Gonzales stated that they found the problem at the sewer plant and the test for the sludge came back fine.
