HomeMy WebLinkAboutOrd 992-2022 School Zone for Sherley ElementaryCITY OF ANNA, TEXAS ORDINANCE NO. qQc?— v�Da2� AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ANNA CITY CODE OF ORDINANCES BY AMENDING PART II, ARTICLE 59, SECTION 3 RELATED TO SCHOOL SPEED ZONES; PROVIDING FOR A PENALTY; PROVIDING FOR SAVINGS, SEVERABILITY, AND REPEALING CLAUSES; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION THEREOF. WHEREAS, the City of Anna, Texas ("the City") has previously adopted ordinances, rules, and regulations governing traffic in the areas of the City's Public Schools; and, WHEREAS, the City of Anna, Texas City Council has investigated and determined that it would be advantageous and beneficial to the City and its citizens to amend Part II, Article 59, Section 3, of the City of Anna Code of Ordinances ("Anna Code") by amending the provisions of Section 3 to include, within a school speed zone, the addition of a newly opening elementary school campus at 3000 FM 2862. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT: Section 1. Recitals Incorporated. The above -referenced recitals are incorporated herein as if set forth in full for all purposes. Section 2. Amendments. In accordance with Part 11, Article 1, Section 9 of the Anna Code, the following amendment is made to Part II, Article 59, Section 3 by adding a new subscription (g) to read as follows: 3.05 School Zone Speed Limits (g) FM 2862 and County Road 425 near Sherley Elementary School. A maximum speed of 20 miles per hour is established for periods beginning 30 minutes before the start of school and ending 30 minutes after school ends for the day. Section 3. Penalty. Any Person violating any of the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not to exceed $200, unless otherwise specifically set forth in this code. Section 4. Savings, Severability and Repealing Clauses. All ordinances of the City in conflict with the provisions of this ordinance are repealed to the extent of that conflict. If any provision of this ordinance shall be held to be invalid or unconstitutional, the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part thereof. The City declares that it would have passed this ordinance and each section, subsection, clause, or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional ort invalid. Section 5. Publication of the Caption Hereof and Effective Date. This ordinance shall be in full force and effective from and after its passage and upon the posting and/or publication, if required by law, of its caption and the City Secretary is hereby directed to implement such posting and/or publication.
