ORDINANCE NO. 111-2003
AN ORDINANCE OF THE CITY OF ANNA, TEXAS, ESTABLISHING A POLICY FOR WATER
SERVICE RECONNECTION; ESTABLISHING A REPEAL CLAUSE; ESTABLISHING A
SAVINGS CLAUSE; ESTABLISHING A PENALTY FOR VIOLATION OF THE PROVISIONS
OF THE ORDINANCE; AND ESTABLISHING AN EFFECTIVE DATE
WHEREAS, the City of Anna operates a water production, storage, and distribution system as a
service to residents, property owners, and other users of the system; and
WHEREAS, certain regulations governing the use of the water system operated by the City of
Anna are necessary to insure orderly and efficient operations and to protect the health and
welfare of the citizens of the city; and
WHEREAS, the City Council of the City of Anna has concluded that revisions of the water
service reconnection procedures are necessary to provide convenient and effective service to
the customers of the water system; now therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT
Section 1. Water Service Reconnection Policy
(a) If a water customer's meter has been cut off due to non-payment and the customer
pays the bill during normal work hours (8:00 a.m. — 12 noon; 1:00 — 5:00 p.m),
including any additional charges such as late penalties, the Public Works Department
of the City will turn the customer's water on that same day.
(b) If a water customer requires water reconnection at other than normal work hours, the
reconnection will be made under the following conditions:
• The amount due is paid in full, including the customer reconnect fee and an
additional fifty dollar ($50.00) after-hours reconnection charge, to the Public
Works Department employee who is sent to reconnect the water service.
• The amount due, including the after-hours reconnection charge, is paid by
check or money order. Cash will not be accepted.
• The check or money order is made payable to the City of Anna.
(c) The Public Works employee who reconnects water service will make every effort to
insure that water is not running on the customer's side of the meter when the
reconnection is made. If the water meter indicates that water is running on the
customer's side of the meter, the employee will discontinue water service by turning off
the meter. The customer is then responsible for contacting the City to reconnect the
service. If the reconnection is required at other than normal work hours, an additional
$50.00 reconnection charge will be added to the customer's bill.

Section 2. Repeal Clause
All parts of any ordinance in conflict with the provisions of this ordinance are to the extent of
such conflict hereby repealed.
Section 3. Savings Clause
If any provision of this ordinance shall be held to be invalid or unconstitutional, the remainder
of such ordinance shall continue in full force and effect the same as if such invalid or
unconstitutional provision had never been a part hereof.
Section 4. Effective Date
This ordinance shall be effective upon the posting and/or publication of its caption as required
by law and the City Secretary is hereby directed to implement such posting and/or publication.
Section 5. Penalty
Any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor
and upon conviction shall be subject to a fine not to exceed the maximum as prescribed by the
statutes of the State of Texas. Each day of violation may be considered a separate offense
under the provisions of this ordinance. Each transaction in violation of any provision hereof
shall be deemed a separate offense. Prosecution or conviction under this provision shall not
be a bar to any other remedy or relief for violations of this ordinance.
PASSED by the City Council of the City of Anna, Texas, by the following vote on this the 14th
day of October, 2003.
