AN ORDINANCE OF THE CITY OF ANNA, TEXAS, ABANDON THE
ENTIRE LENGTH OF THE 20" ALLEY ADJOINING LOTS I K34
OF THE ORIGINAL TOWN OF ANNA,,-YROVIDING FOR REU 15G,

WHEREAS, the City of Anna., Texas ("Anna") has received a request= r tI'agid.
Wood, Raymond E. Stone and Elizabeth A. Stone to abandon the 20" alleyn,Lot
Block 3 of the Original Towyn of Anna, as more firlly described and depicts�`urvey P t Liri
marked Exhibit "A'" attached hereto and incorporated herein by reference (the "Alley")., �d
WHEREAS, the City Council of Anna (the "City Council") has held a public hearing on
the abandonment and notified the abutting property owners of the proposed abandonment of the
portion of the alley; and
WHEREAS, the City Council has investigated and determined that it is in the best
interest and for the purpose of benefitting the public generally to abandon the alley, and it is not
solely for the benefit of private interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ANTA, TEXAS:
SECTION l : Findings Incomorated. The findings set forth above are incorporated into
the body of this Ordinance as if fully set forth herein.
SECTION 2= Abandonment of Alley. Anna hereby abandons the entire length of the 20"
alley adjoining Lots 1-9, Block 3 of the Original Towyn of Anna, as more fully described and
depicted on the attached Survey Plat.
SECTION 3: Savings/Repealing Clause. All provisions of any ordinance in conflict
%with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall
not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal
prevent a prosecution from being commenced for any violation if occurring prior to the repeal of
the ordinance. Any remaining portions of said ordinances shall remain in full force and effect.
SECTION 4- Severability. Should any section, subsection, sentence, clause or phrase of
this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is
expressly provided that any and all remaining portions of this Ordinance shall remain in full
force and effect. Anna hereby declares that it would have passed this Ordinance, and each
section, subsection, clause or phrase thereof irrespective of the fact that any one or more
sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid.
SECTION 5: Effective Date.. This Ordinance shall be effective immediately upon its
passage.
