ORDINANCE NO. 80-2003
AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ZONING
MAP OF THE CITY OF ANNA TO PROVIDE FOR REZONING OF CERTAIN
PROPERTY; PROVIDING A REPEALER CLAUSE; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the owner of the property described in Exhibit A attached hereto has requested a
certain zoning for said property; and
WHEREAS, the City Council of the City of Anna has given the requisite notices and afforded a
full and fair hearing to all property owners generally and to all persons interested in and situated
in the affected area and in the vicinity thereof, the City Council of the City of Anna has
concluded that the Zoning Ordinance of the City of Anna should be amended as follows:
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS:
Section 1. The Comprehensive Zoning Ordinance of the City of Anna, Texas, is amended by
zoning the tract described in Exhibit A, attached hereto and made an integral part of this
Ordinance, as Planned Development (PD). The Planned Development shall include the
following elements:
A. Permitted Uses in the Planned Development:
The permitted uses will be the same as those permitted in the "R-1 — Single Family
Residential' zoning district of the City of Anna Zoning Ordinance.
B. Setbacks:
Minimum front yard — 25 feet.
Minimum side yard — 5 feet; however, 15 feet shall be required on a corner lot adjacent to a
side street.
Minimum rear yard — 20 feet.
C. Lot Dimensions:
The minimum dimensions for residential lots will be as follows:
Minimum lot area — 6,000 square feet, with a 6,500 square foot minimum average; at least
25% of the lots in the PD shall be a minimum of 7,500 square feet.
Minimum lot width — 50 feet at building line
Minimum lot depth — 100 feet
D. Minimum Dwelling Area:
Minimum 1,300 square feet air conditioned living space
E. Maximum Height:
Two and one-half (2 '/2) stories or thirty-five (35) feet, whichever is greater (excluding
chimneys and vent stacks, cupolas, entry features, skylights, and other architectural

features not intended for occupancy or storage).
F. Maximum Lot Coverage:
Maximum lot coverage will be forty percent (40%). "Coverage" means the percentage of lot
area covered by a roof or other structure (including accessory structures).
G. Off -Street Parking:
A minimum of two (2) enclosed off-street parking spaces will be provided for each dwelling
unit (which spaces must be located on the same lot as the dwelling unit).
H. Masonry Requirements:
Exterior building materials for residential structures shall be at least 70% masonry, with
100% masonry required on the ground floor.
Sidewalks:
Sidewalks shall be required along the north and east side of streets as shown on the
"Zoning Exhibit for Park Place", dated June 24, 2003, and located in the permanent files of
the Office of the City Secretary. Sidewalks will be installed prior to the issuance of a final
certificate of occupancy for each house constructed on a lot on which a sidewalk is required.
There shall be a sidewalk along the outside perimeter of the development where such
perimeter abuts a collector or thoroughfare street.
J. Retaining Walls:
Retaining walls shall be constructed with stone or split faced concrete block of comparable
material.
K. Roof Pitch:
Minimum roof pitch shall be 5 in 12.
L. Park Amenities and Fees:
a. A hike/bike path will be constructed along east side of Throckmorton Creek. The path
shall be 5 — 8 feet in width and shall be of concrete construction according to
specifications for standard sidewalks. Developer shall submit path construction
specifications to City for approval. Path width shall be 8' except in areas where tree
location and/or topography requires a lesser width.
b. A green belt area roughly comparable to the area identified on the "Zoning Exhibit for
Park Place", dated June24, 2003, shall be dedicated to the City of Anna. A 50% credit
against park fees will be given in return for this donation.
c. A play area/pocket park will be developed within the subdivision, at a location generally
identified on the "Zoning Exhibit for Park Place", dated June24, 2003. A credit against
park fees will be given on a dollar for dollar basis for equipment and facilities located at
the park site, said credit not to exceed $50,000. Developer will be responsible for
providing to City adequate documentation to verify equipment and facility
costs/expenses.
Section 2. The official Zoning Map of the City of Anna shall be amended to reflect the change in
zoning described herein.
Section 3. All ordinances of the City of Anna in conflict with the provisions of this ordinance are
repealed to the extent of that conflict.

Section 4. This Ordinance shall take effect immediately from and after its passage as the law in
such cases provides.

LEGAL DESCRIPTION
BEING a tract of land situated in the Thomas Rattan Survey, Abstract Number 782, Collin
County, Texas and being all of that land described by deed recorded in Volume 2080, Page 258,
Deed Records, Collin County, Texas and being more particularly described by metes and bounds
as follows:
BEGINNING at a steel rod found in the south right-of-way line of F.M. Highway 455 and
being the northeast comer of said deed;
THENCE S00°11'26"E, 2430.44 feet leaving said right-of-way line to a steel rod found;
THENCE S89029'27"W, 906.64 feet to a point in the center of Throckmorton Creek;
THENCE N29009'07"E, 13.33 feet along said center of Throckmorton Creek;
THENCE NO 1003'48"W, 1495.16 feet leaving said center of Throckmorton Creek to a steel rod;
THENCE N01°52'11"W, 1022.91 feet, to right-of-way monument in the aforementioned south
right-of-way line said point being the north west comer of said Anna 116 Assoc. tract, the
beginning of a non -tangent curve to the left;
THENCE with said non -tangent curve to the left, an arc distance of 204.24 feet, through a
central angle of 29°23'43", having a radius of 398.10 feet, the long chord of which bears
S62°21'15"E, 202.01 feet, an arc distance of 204.24 feet along the aforementioned south right-of-
way line, the beginning of a non -tangent curve to the left;
THENCE with said non -tangent curve to the left, an arc distance of 479.39 feet, through a
central angle of 35°57'45", having a radius of 763.77 feet, the long chord of which bears
S84°30'01 "E, 471.56 feet, an arc distance of 479.39 feet continuing along the aforementioned
south right-of-way line;
THENCE N80057'11"E, 308.35 feet continuing along the aforementioned south right-of-way
line to the POINT OF BEGINNING and containing 50.961 acres of land, more or less.
