HomeMy WebLinkAboutOrd 121-2003 Rezoning-PD- 9.061 Acre Fagala Tract.pdfCITY OF ANNA, TEXAS ORDINANCE NO. 121-2003 (9.061 ACRE FAGALA TRACT) AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ZONING MAP OF THE CITY OF ANNA TO PROVIDE FOR REZONING OF CERTAIN PROPERTY; PROVIDING A REPEALER CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the owner of the property described in Exhibit B attached hereto has requested a certain zoning for said property; and WHEREAS, the City Council of the City of Anna has given the requisite notices and afforded a full and fair hearing to all property owners generally and to all persons interested in and situated in the affected area and in the vicinity thereof, the City Council of the City of Anna has concluded that the Zoning Ordinance of the City of Anna should be amended as follows: NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS: Section 1. The comprehensive Zoning Ordinance of the City of Anna, Texas, is amended by zoning the property described in Exhibit A as Planned Development No. 21-2003 (PD 21-2003). Section 2. The Planned Development No. 21-2003 shall have the following zoning use regulations. ZONING REGULATIONS The property described in Exhibit A shall be zoned as C-2 Commercial District except as follows: Motel, motor hotel, or motor lodge Travel trailer park Cemetery or mausoleum Civic center Community center, public Community center, private Fraternal organization, lodge or civic club Kennel, outside pens Rehabilitation care facility School, public (primary and/or secondary) Stadium or playfield, public Swimming pool, private Heliport or heliatop Radio, TV or microwave oper., amateur Permitted with speck use permit Not permitted Not permitted Permitted with a speck use permit Permitted with a specific use permit Permitted with a specific use permit Permitted with a specific use permit Not permitted Permitted Permitted with a specific use permit Not permitted Not permitted Not permitted Not permitted 121-2003 Rezoning — Fagala 9 Acres 12-09-03 Page 1 of 2 Radio, TV or microwave oper., crammer. Service yards of government agency Transit station or turnaround Auto leasing and rental Auto paint and body shop Automobile and trailer sales area, new Automobile and trailer sales area, used Bus terminal Tire dealer (with outside storage) Heavy machinery sales Massage parlor Metal dealer, crafted precious Nude modeling studio Trailer, manufactured housing or mobile hone display and sales Veterinarian clinic (outside pens) Not permitted Not permitted Not permitted Not permitted Permitted with a specific use permit Not permitted Not permitted Not permitted Not permitted Not permitted Not permitted Permitted with a speck use permit Not permitted Not permitted Not permitted Section 3. All provisions of the City of Anna Zoning Ordinance not in conflict with the provisions of this ordinance shall pertain to the property described in Exhibit B. Section 4. The official Zoning Map of the City of Anna shall be corrected to reflect the change in zoning described herein. Section 5. All ordinances of the City of Anna in conflict with the provisions of this ordinance are repealed to the extent of that conflict. Section 6. This Ordinance shall take effect immediately from and after its passage and the publication of the caption of said ordinance as the law in such case provides.
