ORDINANCE NO. 127-2004
ZONING —52.71 ACRES (BURLESON)
AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE ZONING
MAP OF THE CITY OF ANNA TO PROVIDE FOR REZONING OF CERTAIN
PROPERTY; PROVIDING A REPEALER CLAUSE; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the owner of the property described in Exhibit A attached hereto has requested a
certain zoning for said property; and
WHEREAS, the City Council of the City of Anna has given the requisite notices and afforded a
full and fair hearing to all property owners generally and to all persons interested in and situated
in the affected area and in the vicinity thereof, the City Council of the City of Anna has
concluded that the Zoning Ordinance of the City of Anna should be amended as follows:
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS:
Section 1.
The Comprehensive Zoning Ordinance of the City of Anna, Texas, is amended by zoning the
tract described in Exhibit A, attached hereto and made an integral part of this Ordinance, as
Planned Development No. 22-2004. The Planned Development shall include the following
elements:
Residential Element
The permitted uses in the area designated as Residential on the Concept Plan (Exhibit B) will
be the same as those permitted in the "SF -72 — Single Family Residential' zoning district with
the following amendments:
Minimum dwelling area requirements shall be one thousand two hundred (1,200) square
feet for a maximum of twenty-five percent (25%) of the lots in the Residential part of the
development.
2. Minimum dwelling area requirements shall be one thousand four hundred (1,400) square
feet for a maximum of fifty percent (50%) of the lots in the Residential part of the
development.
3. Minimum dwelling area requirements shall be one thousand six hundred (1,600) square
feet for at least fifty percent (50%) of the lots in the Residential part of the development.
Commercial Element
The Commercial element of the project shall conform to all requirements of the City of Anna C-1
Commercial District.

All provisions of the Zoning Ordinance of the City of Anna not in conflict with the provisions of
this section shall be applicable to the tract described in Exhibit A.
Section 2.
The official Zoning Map of the City of Anna shall be corrected to reflect the change in zoning
described herein.
Section 3.
All ordinances of the City of Anna in conflict with the provisions of this ordinance are repealed to
the extent of that conflict.
Section 4.
This Ordinance shall take effect immediately from and after its passage by the City Council and
approval by the Mayor.

STATE OF TEXAS COUNTY OF COLLIN
Being a tract or parcel of land situated in the J. C. Brantley Survey, Abstract No. 114,
Collin County, Texas and being that same called 52.573 acre tract of land conveyed from
Miles 1. Morrison, Trustee, to H. R. Hudson by Deed dated April 26, 1974 and recorded
in Volume 912, Page 596, Deed Records, Collin County, Texas, and being more
particulerly described as follows:
BEGINNING at a P.KNail set for a corner in the County Road 425, said point being the
Southeast corner of said 52.573 acre tract and the Northeast corner of that tract
conveyed to Cary and Janet Bartoo by Deed recorded in Volume 4634, Page 960,

THENCE: South 88'48' 00'; (Basis of Bearings), along a common line between said
52.573 acre tract and Bartoo tract, a tract conveyed to Peter L. Giese &: wife, that tract
conveyed to Martha .D. Miller, that tract conveyed to W. L. Templin and Geneva Roper
and that tract conveyed to Jerry L. &: Wanda L. Wynn, a total distance of 2897.82 ft. to a
1/2" iron rod found for a corner on the Easterly line of the Dallas Area Rapid Transit
Rail Line, said point also being the Northwest comerof said Wynn tract and located on a
curve to the left, having a central
angle of 13'26'29", a radius of 2914.93 and a chord that bears North 17'17'50" West a
distance of 682.26 feet;
THENCE: Along the arc of said curve and along said Easterly ROW line, an arc distance
of 683.83 feet to a 1/2" iron rod set for a corner;
THENCE: North 24° 03'06" West, continueing along said ROW line, a distance of 357.
72 feet to a 1/2" iron rod found for a corner, said point being the North- west corner of
said 52. 573 acre tract and the Southwest corner of that tract conveyed to Robert C. &:
Sharon E. Relyea;
THENCE: North 88'57'43" Ea:st, along the common line between said 52.573 acre tract
and said Relyea tract, a tract of land conveyed to James Seibold and Christine Stromberg
and part of that tract conveyed to Donald B. & Nova M. Braley, a distance of 2440.24
feet to a 1/2" iron rod found for a corner, said point also being the Northwest corner of
that tract of land conveyed to Dale & Marie J Heath;
THENCE: South 00'38156" West, along the common line between said 52.573 acre tract
and said Heath tract and a tract conveyed to Julio Medina & wife Audelia Medina a
distance of 855.32 Jeet to a 1/2" iron rod found for a corner;
THENCE: North 88' 45' 39" East, along the South lines of said Medina tract and that
tract conveyed to Jacqueline D. Neal, a distance of 815.98 feet to a PK nail set in the
pavement of County Road No. 425;
771ENCE: South 00'0-3'05" West, alongsaidpavement a distance of 123.97feet to the
Point OfBeginning anct containing 2,1296,055 sq. feet or 52.71 acres of land.
