HomeMy WebLinkAboutOrd 131-2004 Utility Rates.pdfCITY OF ANNA, TEXAS ORDINANCE NO. 131-2004 AN ORDINANCE BY THE CITY OF ANNA, TEXAS, AMENDING ORDINANCE NO. 79.2003 BY REVISING WATER AND SANITARY SEWER SERVICE RATES, SETTING THE EFFECTIVE DATE OF THE NEW RATES; ESTABLISHING A REPEAL CLAUSE; ESTABLISHING A SAVINGS CLAUSE; ESTABLISHING A PENALTY FOR VIOLATION OF THE PROVISIONS OF THE ORDINANCE; AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, the City of Anna operates a water production, storage, and distribution system and a sanitary sewer collection and treatment system as a service to residents, property owners and other users of the system; and WHEREAS, certain regulations governing the use of the water and sanitary sewer systems operated by the City of Anna are necessary to insure orderly and efficient operations and to protect the health and welfare of the citizens of the city; and WHEREAS, the City Council of Anna has carefully evaluated the financial status of the water and sanitary sewer systems of the city and has concluded that revisions of the water and sanitary sewer service rate structure are necessary to maintain the financial integrity of the water and sanitary sewer service systems; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS THAT: Section 1 of Ordinance No. 79-2003 is hereby amended to read as follows: Section 1. Water and Sanitary Sewer Service Rates (a) Inside City Water Rates — All customers Each customer shall pay a minimum charge of $19.50 for the first 2,000 gallons of water usage plus a usage charge of $4.00 for each additional 1,000 gallons of water used between 2,000 and 10,000 gallons and $4.50 for each additional 1,000 gallons in excess of 10,000 gallons. (b) Inside City Sanitary Sewer Rates — Residential customers Each customer shall pay a minimum charge of $20.00 for the first 2,000 gallons of water usage plus a usage charge of $2.50 for each additional 1,000 gallons of water used, except that the maximum monthly charge shall not exceed $50.00 for sanitary sewer service charges. (c) Outside City Water and Sanitary Sewer Rates — Residential customers Each customer shall pay one and one-half (1.5) times the rate charged to customers inside the city limits, except that the maximum monthly charge shall not exceed $50.00 for sanitary sewer service charges. 131-2004 Water/Sewer Rates 03/16/2004 Page 1 of 2 (d) Sanitary Sewer Rates — Commercial and industrial customers Each customer shall pay a minimum charge of $20.00 for the first 2,000 gallons of water usage plus a usage charge of $2.50 for each additional 1,000 gallons of water used. Section 2. Repeal Clause All parts of any ordinance in conflict with the provisions of this ordinance are to the extent of such conflict hereby repealed. Section 3. Savings Clause If any provision of this ordinance shall be held to be invalid or unconstitutional, the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part hereof. Section 4. Effective Date This ordinance shall be effective on the first billing cycle of January 2006 upon the posting and/or publication of its caption as required by law and the City Secretary is hereby directed to implement such posting and/or publication. Section 5. Penalty Any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be subject to a fine not to exceed the maximum as prescribed by the statutes of the State of Texas. Each day of violation may be considered a separate offense under the provisions of this ordinance. Each transaction in violation of any provision hereof shall be deemed as a separate offense. Prosecution or conviction under this provision shall not be a bar to any other remedy or relief for violations of this ordinance.
