ORDINANCE NO. 406-2008
AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE CITY OF ANNA
CODE OF ORDINANCES BY AMENDING PART III -D, (SIGN REGULATIONS),
ARTICLE I, SECTION 1 PROVIDING FOR CERTAIN DEFINITIONS AND ARTICLE IV,
SECTION 6 REGARDING MAJOR FREESTANDING SIGNS; PROVIDING FOR A
PENALTY FOR ANY VIOLATION OF THIS ORDINANCE NOT TO EXCEED $2,000;
PROVIDING FOR SAVINGS, SEVERABILITY, AND REPEALING CLAUSES;
PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR THE PUBLICATION
OF THE CAPTION HEREOF.
WHEREAS, the City of Anna, Texas (the "City") has previously adopted ordinances,
rules and regulations governing signs; and
WHEREAS, the City of Anna, Texas City Council has investigated and determined
that it would be advantageous and beneficial to the City and its citizens to amend
Part III -D, Article I and Article IV, Section 6 of the Sign Regulations of the City of
Anna Code of Ordinances (the "Anna Code") with respect to On -Premises Signs and
Major Freestanding Signs;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Recitals Incorporated.
The above -referenced recitals are incorporated herein as if set forth in full for all
purposes.
Section 2. Amendment to Part 111-0, Article 1(Sign Regulations).
In accordance with Part 11, Article 1, Section 9 of the Anna Code, the following
amendment is made to the definition of "On -Premises Sign" in Anna Code, Part III -D,
Article I (Sign Regulations).
On -Premises Sign means a sign identifying or advertising a business.
Person, or activity, and installed and maintained on the same premises as
the business, Person, or activity.
Section 3. Amendment to Part 111-D, Article IV, Section 6 (Sign Regulations).
In accordance with Part II, Article 1, Section 9 of Anna Code, the following amendment
is made to Anna Code, Part III -D, Article IV, Section 6 (Sign Regulations).

Section 6. Class 5, Major Freestanding Signs
(a) Class 5 major freestanding signs are prohibited, except as fellews:

(1) is adjacent to U.S. 75/Central Expressway or S.H. 121. Provided
that said signs may must be located within a
distance of 50 feet from the right-of-way line of the linear segment

(2) was part of a parent tract, any part of which was adiacent to and
within the U.S. 75/Central Expressway Corridor as of January 1.
2007, provided that said sign is located adjacent to a thoroughfare
other than U.S. 75/Central Expressway and is no more than 50 feet
from the edge of said thoroughfare and situated so as to be viewed
from said thoroughfare.
b (2) In any location not described in subsection (a)(1) or (a)(2) On -
Premises signs shall be restricted to ground signs only.

recommend to the City Council an exception to allow a pole sign at a
location where prohibited herein if the sign-beardBoard of Adjustment
determines that a general condition of pole signs exists in the
immediate vicinity and the proposed pole sign would be consistent with
such established conditions. The recommendation shall be submitted
to the City Council for final decision.
J-(3) With respect to subsection (a)(1). If if the stated linear segment does
not reference a beginning or ending cross -street, the segment shall
mean the entire length of such street within the corporate limits or from
the stated cross -street to the corporate limits as the case may be.

Section 4. Penalty.
A violation of any of the terms of this ordinance, whether denominated in this ordinance
as unlawful or not, shall be deemed a misdemeanor. Any person convicted of any such
violation shall be fined in an amount not to exceed $2,000 for each incidence of
violation. Each violation is considered a separate offense and will be punished
separately.
Section 5. Savings, Severability and Repealing Clauses.
All ordinances of the City in conflict with the provisions of this ordinance are repealed to
the extent of that conflict. If any provision of this ordinance shall be heli to be invalid or
unconstitutional, the remainder of such ordinance shall continue in full force and effect
the same as if such invalid or unconstitutional provision had never been a part hereof.
The City declares that it would have passed this ordinance, and each section,
subsection, clause, or phrase thereof irrespective of the fact that any one or more
section, subsection, sentence, clause, or phrase be declared unconstitutional or invalid.
Section 6. Publication of the Caption Hereof and Effective Date.
This ordinance shall be in full force and effective from and after its passage and upon
the posting and/or publication, N required by law, of its caption and the City Secretary is
hereby directed to implement such posting and/or publication.
PASSED by the City Council of the City of Anna, Texas, this 23rd day of September,
