HomeMy WebLinkAboutOrd 550-2011 Changing Anna ISD School Zones.pdfCITY OF ANNA, TEXAS ORDINANCE NO. 550-2011 AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE CITY OF ANNA CODE OF ORDINANCES BY AMENDING PART 11, ARTICLE 59, SECTIONS 2 AND 3; PROVIDING FOR A PENALTY FOR ANY VIOLATION OF THIS ORDINANCE NOT TO EXCEED $500 OR THE HIGHEST AMOUNT ALLOWED UNDER LAW, WHICHEVER IS LOWER; PROVIDING FOR SAVINGS, SEVERABILITY, AND REPEALING CLAUSES; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF. WHEREAS, the City of Anna, Texas ("the City") has previously adopted ordinances, rules and regulations governing traffic speeds and parking in the areas of the City's public schools; and WHEREAS, the City of Anna City Council has found and determined that the prima facie speed limit on the streets and highway that are the subject of this ordinance are unreasonable and unsafe; and WHEREAS, the City of Anna, Texas City Council has investigated and determined that it would be advantageous and beneficial to the City and its citizens to amend Part II, Article 59, Sections 2 and 3, of the City of Anna Code of Ordinances ("Anna Code") by repealing the provisions of Section 2 and by amending Section 3 to include the addition of the new Anna High School site. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT: Section 1. Recitals Incorporated. The above -referenced recitals are incorporated herein as if set forth in full for all purposes. Section 2. Amendments. 2.01 In accordance with Part II, Article 1, Section 9 of Anna, the following amendment is made to Part II, Article 59, Section 2 by eliminating from the Anna Code Section 2.03, 2.04 and 2.05 and by renumbering the remainder of Section 2 as follows: - -- -- - -- Ord. 550-2011 Changing Anna ISD School Zones PAGE 1 OF 6 07-12-11 it 1 2:862.03 Penalty Any Person who fails to comply with or violates any of the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not more than $500 and each and every day of such violation shall be a separate and complete offense, unless otherwise specifically set forth in this Code. A maximum speed of 25 miles per hour is established for the periods beginning 30 minutes before the start of school and ending 15 minutes after the start of school; starting again 15 minutes before the end of school and ending 30 minutes after school ends for the day; aad (b) CR 371. A maximum speed of 25 miles per hour is established for the periods beginning 30 minutes before the start of school and ending 15 minutes after the start of school; starting again 15 minutes before the end of school and ending 30 minutes after school ends for the day.. (c) West Crossing Blvd A maximum speed of 25 miles per hour is established for the periods beginning 30 minutes before the start of school and ending 15 minutes after the start of school; starting again 15 minutes before the end of school and ending 30 minutes after school ends for the day; and (d) Rosamond Parkway. A maximum speed of 25 miles per hour is established for the periods beginning 30 minutes before the start of school and ending 15 minutes after the start of school; starting again 15 minutes before the end of school and ending 30 minutes after school ends for the day. 96th All of these above -stated school speed zones shall be effective in the areas between the school zone signage and in effect on days when school is in session. (Ord. No. 1991-02, adopted 11/12/1991; Ord. No. adopted 07/26/2011) Section 3. Penalty. Any Person deemed guilty of violating any of the provisions of this section shall be in violation of this ordinance and shall be fined in an amount not to exceed $500.00 or the highest amount allowed under law, whichever is lower, for each incidence of violation. Each violation is considered a separate offense and will be punished separately. Section 4. Savings, Severability and Repealing Clauses. All ordinances of the City in conflict with the provisions of this ordinance are repealed to the extent of that conflict. If any provision of this ordinance shall be held to be invalid or unconstitutional, the remainder of such ordinance shall continue in full force and effect the same as if such invalid or unconstitutional provision had never been a part hereof. The City declares that it would have passed this ordinance, and each section, Ord. 550-2011 Changing Anna ISD School Zones PAGE 3 OF 5 07-12-11 subsection, clause, or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, and phrases be declared unconstitutional or invalid. This ordinance shall be in full force and effective from and after its passage and upon the posting and/or publication, if required by law, of its caption and the City Secretary is hereby directed to implement such posting and/or publication.
