ORDINANCE NO. 552-2011
AN ORDINANCE OF THE CITY OF ANNA, TEXAS, AMENDING THE CITY OF ANNA
PERSONNEL POLICY MANUAL REGARDING CITY COUNCIL AUTHORITY TO
GRANT EXEMPTIONS FROM APPLICATION OF PROVISIONS OF MANUAL
WHEREAS, the City of Anna, Texas ("the City") has previously adopted the City of
Anna Personnel Policy Manual ("the Manual"), which describes guidelines and
policies for the City's personnel; and
WHEREAS, the City of Anna, Texas City Council ("City Council") has determined
that the Manual is in need of updating with respect to the City Council's authority to
grant certain exemptions with respect to employees that are City Council appointees.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Recitals Incorporated.
The above -referenced recitals are incorporated herein as if set forth in full for all
purposes.
Section 2. Amendment to Personnel Policy Manual.
Section 1.03 of the Manual is hereby amended as follows:
1.03 Application of Policies
These rules shall apply to all City employees except where otherwise
specifically exempted by these rules or by written agreement.
Notwithstandinq any other provision of these policies, rules and
regulations, the City Council may exempt City employees that the City
Council appoints pursuant to its power under the City's Home -Rule
Charter from the application of certain policies, rules and regulations and
may do so by ordinance, resolution or written agreement. However, the
City Council may not exempt such employees from rules, policies or
regulations related to sexual harassment and may not grant any
exemption that would result in a violation of state or federal law.

Section 3. Savings, Severability and Repealing Clauses.
All ordinances of the City in conflict with the provisions of this ordinance are
repealed to the extent of the conflict. If any section, subsection, sentence, clause,
or phrase of this ordinance, or its application to a particular set of persons or
circumstances, is declared invalid or adjudged unconstitutional by a court of
competent jurisdiction, it does not affect the remaining portions of this ordinance,
as the various portions and provisions of this ordinance are severable. The City
Council, declares that it would have passed each and every part of this ordinance
notwithstanding the omission of any part that is declared invalid or
unconstitutional.
Section 4. Effective Date.
This ordinance shall become effective immediately upon adoption.
PASSED by the City Council of the City of Anna, Texas, on this the 2"d day of August,
2011.
