AN ORDINANCE OF THE CITY OF ANNA, TEXAS AMENDING THE CITY'S
COMPREHENSIVE PLAN, ZONING MAP, AND ZONING ORDINANCE AND CHANGING
THE ZONING OF CERTAIN PROPERTIES AS DESCRIBED HEREIN; PROVIDING FOR
SAVINGS, REPEALING AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE
DATE; PROVIDING FOR A PENALTY CLAUSE NOT TO EXCEED $2,000 OR THE HIGHEST
PENALTY AMOUNT ALLOWED BY LAW, WHICHEVER IS LESS; AND, PROVIDING FOR
THE PUBLICATION OF THE CAPTION HEREOF.
WHEREAS, the owner of the property described in Exhibit A attached hereto has requested a certain
zoning for said property; and
WHEREAS, the Planning and Zoning Commission of the City of Anna and the City Council of the City
of Anna have given the requisite notices by publication and otherwise and have held the public hearings
as required by law and afforded a full and fair hearing to all property owners generally and to all persons
interested in and situated in the affected area and in the vicinity thereof, the City Council of the City of
Anna has concluded that the Zoning Ordinance of the City of Anna should be amended as follows:
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS:
Section 1. The Comprehensive Zoning Ordinance of the City of Anna, Texas, is amended by changing
the zoning of the tract described in Exhibit A, attached hereto and made an integral part of this ordinance,
from Restricted Commercial (Cl) to Restricted Commercial (Cl) zoning with a Specific Use Permit
("SUP") to allow alcoholic beverages to be served and consumed on the premises in connection with
those private events for which no Texas Alcoholic Beverage license or permit is held and no such license
or permit is required to be held.
CONDITIONS APPLICABLE TO GRANTING OF SUP:
a. All other provisions of the C-1 Restricted Commercial District in the existing City of
Anna Zoning Ordinance are applicable to the tract and any uses of the tract.
b. The service and consumption of alcoholic beverages is strictly limited such that only the
persons organizing the event and their invited guests may consume alcoholic beverages and
consumption of alcoholic beverages is strictly prohibited anywhere outside of an enclosed
building; further, consumption of alcohol by members of the general public not invited to the
event is strictly prohibited.
C. All consumption of alcoholic beverages must be completely free of charge. A "charge"
includes a payment required in order to enter a building or premises, a payment for parking, a
payment for food or other thing of value, or any other payment that may be required to consume
alcoholic beverages or to enter or access the premises.
d. No service or consumption of alcoholic beverages may take place unless such service or
consumption is between the hours starting at 12 noon and ending at midnight.
e. No service or consumption of alcoholic beverages may take place unless the City
Manager has received a written application and granted a permit for the private event. "City

Manager" means the City Manager of the City of Anna, Texas. There is no charge for such
permit, but the application must be submitted to the City Manager at least 15 days in advance of
the event. Such an application must clearly identify the organizers of the event including full
name, current residential address, telephone number, and email contact information that can be
readily used to contract the event organizer at all times during the event. The written application
must state the date and time of the event, the number of persons expected to attend the event, the
type of alcoholic beverages that will be available at the event (e.g., beer, wine, liquor) and
whether persons attending the event will be allowed to bring their own alcoholic beverages.
f. The organizer of any private event during which alcoholic beverages are to be served or
consumed must be physically present at the event at all times during the event and at least 30
minutes before any alcoholic beverages are served or consumed and at least 30 minutes after any
alcoholic beverages are served or consumed.
Section 2. The official Zoning Map of the City of Anna shall be corrected to reflect the change in zoning
described herein.
Section 3. All ordinances of the City of Anna in conflict with the provisions of this ordinance are
repealed to the extent of that conflict.
Section 4. This Ordinance shall take effect immediately from and after its passage and the publication of
the caption of said ordinance as the law in such case provides.
