HomeMy WebLinkAboutCCmin2005-02-12 Special MeetingMINUTES CITY OF ANNA SPECIAL CITY COUNCIL MEETING February 12, 2005 5:30 PM Community Room, Independent Bank The City Council of the City of Anna met in Special Session at 5:30 P.m., Saturday, February 12, 2005, at the Community Room, Independent Bank, located at 101 S Powell Parkway, to consider the following items. 1. Call to Order. Mayor Kenneth Pelham officially called the meeting to order at 5:33 p.m. 2. Roll Call and Establishment of Quorum. Mayor Kenneth Pelham, Mayor Pro -tem Mark Montgomery, Councilmen Buddy Hayes, JW Finley, Jr., and John Geren were present. Councilman Lynn Mosier was absent. 3. Consider citizen comments and presentations. No Comments. 4. EXECUTIVE SESSION: Under terms of Chapter 551 of Texas Government Code, the City Council may enter into CLOSED SESSION or Executive Session to discuss the following: a. To consult with legal counsel on matters in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Government Code. (Government Code, Chapter 551.071). No executive session was held. 5. Consider action on an Ordinance regulating the sale of alcohol by any establishment that derives 75 percent or more of the establishment's gross revenue from the on -premise sale of alcoholic beverages and prescribing the hours when it may be sold. Mr. Montgomery suggested that the term "on -premises sale of alcoholic beverages" be changed to "on -premises consumption of alcoholic beverages" throughout the ordinance. Motion to adopt ordinance regulating the sale of alcohol by any establishment that derives 75 percent or more of the establishment's gross revenue from the on -premise sale of alcoholic beverages and prescribing the hours when it may be sold with change as noted above by Councilman Mark Montgomery, seconded by J. Consider action on an Ordinance prohibiting the sale of beer in all residential areas of the City. Motion to pass Ordinance No. 183-2005 as presented to council by Councilman J. W. Finley, Jr., seconded by John Geren. 4 aye 0 nay 0 abstained 7. Consider action on an Ordinance regulating the sale of beer for on -premises consumption. There was general discussion regarding health permits, review of permits and future contract with Collin County for health services. Motion to adopt Ordinance No. 184-2005 as presented to council by Councilman Mark Montgomery, seconded by Buddy Hayes. 4 aye 0 nay 0 abstained 8. Consider action on an Ordinance regulating the sale of beer that is not for on - premises consumption. Motion to adopt Ordinance 185-2005 as presented to council but striking language in Section 5b regarding the THOR - Thoroughfare Overlay District by Councilman J. W. Finley, Jr., seconded by John Geren. 4 aye 0 nay 0 abstained 9. Consider action on an Ordinance prescribing the hours when beer may be sold. Concerned with times in ordinance, change section 1 (a) and (b). Motion to approve Ordinance No. 186-2005 as presented with following changes: • Section 1(b) revised to read "any day of the week after midnight until 11:00 a.m. the following day • Section 2(b) eliminated by J. W. Finley, Jr., seconded by Mark Montgomery. 4 aye 0 nay 0 abstained 10. Consider action on an Ordinance prohibiting the sale of alcoholic beverages by a dealer whose place of business is within 300 feet of a church, public school, private school, public hospital, day-care center or child-care facility.
