HomeMy WebLinkAboutCCmin2006-11-20 Special MeetingMINUTES OF CITY OF ANNA SPECIAL CITY COUNCIL MEETING AGENDA November 20, 2006 7:00 PM Community Room, Texas Star Bank The City Council of the City of Anna met in Special Session at 7:00 p.m., Monday, November 20, 2006, at the Community Room, Texas Star Bank, located at 402 W. White Street (FM 455), to consider the following items. 1. Call to Order. Mayor Kenneth Pelham called the meeting to order at 7:00 p.m. 2. Roll Call and Establishment of Quorum. Mayor Kenneth Pelham and Council Members Lynn Mosier, Keith Green, John Garen, David Crim and Billy Deragon were present. Council Member Kevin Anderson arrived at 8:18 p.m. 3. Public Hearing: (1') For Council to hear public comment on the annexation of property along FM 2862 South of SH 121 - 101). Mayor Pelham opened the public hearing at 7:01 p.m. There was no public comment. Mayor Pelham closed the public hearing at 7:02 p.m. 4. Public Hearing: (11°) For Council to hear public comment on the annexation of property along FM 2862 South of SH 121 -#2). City Manager, Lee Lawrence explained the location of the two annexations. Mayor Pelham opened the public hearing at 7:02 p.m. There was no public comment. Mayor Pelham closed the public hearing at 7:03 p.m. 6. Public Hearing: (11`r) For Council to hear public comment on the annexation of property along Hwy. 5 (Powell Pkwy) West on the East Side of CR 423. Mayor Pelham opened the public hearing at 7:03 p.m. White Price stated that he did not have a problem with being annexed but asked not to be annexed till after he had got his day care opened. Mayor Pelham closed the public hearing at 7:09 P.m. Council Member made the motion to go into executive session at 7:10 p.m. Council Member Deragon seconded the motion. Motion passes. Consider/Discuss/Action regarding Anna Center Ltd. and the City of Anna Development Agreement Nancy Underwood introduced everyone present and City Manager, Lee Lawrence stated that he had several concerns with the agreement received such as the penalty clauses, the caps on traffic light, drainage figures, the park development language, etc. Discussion between developer and council members to go over the items of concern in the agreement took place. Recap of the discussion: (1) to add a sentence to 203 (a)(c), 205, 206 (a), 208, to incorporate liquid damages in to contractor's contract's; an additional section 212 spelling out the language to go into the contractor's contract; (2) to split in half, no cap to the cost of the traffic signal; (3) in the construction contracts our engineer will specify a time frame that is reasonable for the completion of the project; (4) the cost of the drainage is to be split equally, no cap; (5) drop the language in 205 dictating what goes in the park and add language that says appropriate public park facilities, previous discussion did include trail; (209) both engineers get together and decide on the look of the drainage, here's the price and go thru the bidding process. Council Member Deragon made the motion to approve the agreement with the changes. Council Member Green seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN 7. CLOSED SESSION: Under Tex. Gov't Code Chapter 551, the City Council may enter Into closed session to: a. discuss or deliberate the purchase, exchange, lease, or value of real property (Tex. Gov't Code §551.072); b. consult with legal counsel on matters in which the duty of the attorney to the governmental body under rine Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Government Code. (Tex. Gov't Code §551.071). c. Personnel: To deliberate regarding Position: Performance Evaluation of the City Manager of the City of Anna, Texas. (Government Code, Section 551.074) The council reserves the right to enter into executive session at any time throughout this meeting under any applicable exception to the Open Meetings Act. S. Consider/Discuss/Action regarding an Inter ocal Agreement between the City of Anna and the Anna ISD for construction of a Natural Gas Line. City Manager, Lee Lawrence explained the estimated cost to the school is a Tittle over $104,000.00 and the remainder will be picked up by the City. The ISD can be reimbursed up to but not more than its contribution to the project. Dr. Wardell stated that he thought this was a good project and that the Sue Rattan 11-20-06 Coundl Minutea-Special.dm 2 11-20-6 Elementary School being built could use the gas now to heat the building while construction is going on. Council Member Crim made the motion to approve the agreement. Council Member Green seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN 0 9. Consider/Discuss/Action regarding P S Z Commission recommendations for revision of the City of Anna Land Use and Thoroughfare Plan. the southern part of the City. City Manager, Lee Lawrence explained some of the changes that are being proposed such as the Outer Loop West of Central Expressway and the Mantua Project. Developer Dick Skorburg of Skorburg Company made a presentation to council against the EastlWest road going through their Town Center Project. Mr. Skorburg suggested a traffic study and suggested the estimated cost for the road would be around $9,000,000.00. Council Member Crim made the motion to approve the Anna Land Use and Thoroughfare Plan without the East/West Road in Town Center and with the changes that have been made on the map. Council Member Anderson seconded the motion. Motion passes. AYE 7 NAY 0 ABSTAIN 0 10. Consider/Discuss/Action regarding the Anna City Hall location on Skorburg Company (Town Center) tract. Developer, Dick Skorburg gave a presentation regarding Anna City Hall on Skorburg (Town Center) tract. Discussion on the roads, trail system, gate way statement (statues, etc.), city hall (municipal buildings), banks, school, retail, medical buildings going in. Mayor Pelham suggested we meet the 1°` and 3itl Wednesday's that way information can be given to council members at the regular meetings and volunteered City Secretary, Natha Wilkison to run the recorder and take notes at such meetings. Council Member Green made the motion to continue with the current location. Council Member Crim seconded the motion. Motion passes. Aye 6 NAY 1(Council Member Mosier) ABSTAIN 11. ConsiderfDiscusstAcgon regarding an Ordinance Authorizing and Allowing Under the Act Governing the TMRS "Updated Service Credits" in said System on an Annual Basis for Service Performed by Qualifying Members of such System Who at the Effective Date of the Allowance are in Employment of the City of Anna. Assistant City Manager, Wayne Cummings stated that staff had gone back and asked each employee for their input about deducting the additional 2% from their checks. Everyone was in favor of increasing the employee deduction from 5% to 7% and the city match being increased to the 2:1 match. Council Member Deragon made the motion to approve the 7% employee deduction and the city Miss on =617 match increase to 2:1. Council Member Crim seconded the motion. Motion passes. AYE 7 NAY 0 ABSTAIN 0 Council Member Deragon made the motion to go into executive session at 9:07 p.m. Council Member Garen seconded the motion. Motion passes. AYE 7 NAY 0 ABSTAIN 0 5 minute recess. City Secretary, Natha Wiikison and Assistant City Manager, Wayne Cummings was sent home. Council Member Mosier made the motion to return to open session at 10:15 p.m. Council Member Anderson seconded the motion. Motion passes. AYE 7 NAY 0 ABSTAIN 0 12. Consider/DiscusstAction regarding City Manager, Lee Lawrence Performance Review. The performance review was a synthesis of city council members. Council Member Crim made the motion to approve the performance review as submitted by the Mayor and for the City Manager to get comments back to all city council members. Council Member Garen seconded the motion. Motion passes. AYE 7 NAY 0 ABSTAIN 0 13. Adjourn. Council Member Deragon made the motion to adjourn at 10:17 p.m. Council Member Mosier seconded the motion.
