HomeMy WebLinkAboutCCmin2007-05-22CITY OF ANNA NOTICE OF RECEPTION TO HONOR OUT GOING COUNCIL MEMBER LYNN MOSIER AND OUR GRATITUDE TO INDEPENDENT BANK AND TEXAS STAR BANK May 22, 2007 6:30 PM Anna City Hall Administration Building The City Council of the City of Anna held a reception to Honor Out Going City Council Member Lynn Mosier and to show our Gratitude to Independent Bank and Texas Star Bank at 6:30 p.m., Tuesday, May 22, 2007 at the Anna City Hall Administration Building, located at III N. Powell Parkway (Hwy 5). Council Member Mosier was unable to attend to receive his plaque. Mayor Pelham presented plaques to Duane Hayes and Buddy Hayes to show the City's gratitude to Texas Star Bank for years of service and to Betty Cowlishaw with Independent Bank. 22 ' -' CITY OF ANNA REGULAR CITY COUNCIL MEETING AGENDA May 22, 2007 7:00 PM Anna City Hall Administration Building The City Council of the City of Anna will meet in Regular Session at 7:00 p.m., Tuesday, May 22, 2007, at the Anna City Hall Administration, Community Room, located at l I 1 North Powell Parkway (Hwy 5), to consider the following items. I. Call to Order. Mayor Kenneth Pelham called the meeting to order at 7:02 p.m. 2. Roll Call and Establishment of Quorum. Mayor Kenneth Pelham and Council Members Kevin Anderson, Keith Green, John Geren, David Crim and Billy Demgon were present. New elect Council Member Mike Crist was absent. 3. Pledge of Allegiance. 0622-07 CCMimrtes.doc 1 05-22-07 4 Citizen comments. Dale King for Kay Algmre to replace trees removed from construction along Smith Street. Mark Pierce has issue with the deposit required (South Grayson WS ex customer) by the city of Anna for new customers. 5. Administer oath of office and present certificate of election to newly elected officials. City Secretary, Natha Wilkison administered the Oath of Office to Mayor Kenneth Pelham and Council Members Keith Green and David Crim. City Secretary, Nadia Wilkison administered the Statement of an Elected Official to Mayor Kenneth Pelham and Mayor Pelham administered the Statement of an Elected Official to Council Members Keith Green and David Crim. 6. Consider/Discuss/Action on electing the Mayor Pro Tem as directed in the City Charter. Council Member David Crim nominated himself to remain Mayor Pro Tem. Council Member Geren seconded the nomination. Council Member Anderson nominated Billy Deragon. Council Member Deragon is the new Mayor Pro Tem. CM Crim received two (2) votes and CM Deragon received four (4) votes. 7. Consider/Discuss/Action on electing the Deputy Mayor Pro Tem as directed in the City Charter. Council Member Geren nominates Council Member Keith Green. Council Member Crim nominates Council Member Anderson. Council Member Green is the new Deputy Mayor Pro Tem. CM Green received four (4) votes and CM Anderson received two (2) votes. S. Consider/DiscusdAction regarding amending appointments to the committee to recommend qualifications to look for in the search of a City Manager. Council Member Decagon nominated Ty Chapman to the committee and that this is the board and will not be revisited. Council Member Geren seconded the motion. Motion passes. Council Member Deragon made the motion to meet Tuesday, May 29, 2007 at 7:00 p.m. Mayor Pelham seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN 0 Council Member Decagon made the motion to go into Executive Session at 7:21 p.m. Council Member Green seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN 0 10. CLOSED SESSION: Under Tex. Gov't Code Chapter 551, the City Council may enter into closed session to: a. discuss or deliberate the purchase, exchange, lease, or value of real property (Tex. Gov't Code §551.072); b. consult with legal counsel on matters in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 661 of the Government Code. (Tex. Gov't Code §661.071) ; c. Personnel: Position of the City Manager of the City of Anna, Texas. (Government Code, Section 651.074) d. To consult with legal counsel regarding pending or contemplated litigation. James Underwood and Carolyn Underwood v. City of Anna, Cause No. 416-1348-07, in the 416M Judicial District Court, Collin County, Texas. The council reserves the right to enter into executive session at any time throughout this meeting under any applicable exception to the Open Meetings Act. Council Member Deragon made the motion to return to open session at 7:37 p.m. Council Member Green seconded the motion. Motion passes. AYE 6 NAY 0 ABSTAIN 0 Short Recess; Return 7:43 p.m. 11. Consider and act upon items listed under than 10 Executive Session, as necessary. Council Member Garen made the motion to take no action. Council Member Green seconded the motion. Motion passes. 05-22-07 WAnutmADc 3 05-22-07 AYE 6 NAY 0 ABSTAIN 0 12. Consider/Discuss/Action regarding an Ordinance governing the burning and chipping of trees for residents and developers. City Attorney, Clark McCoy summarized the ordinance and led the discussion on exceptions listed in the ordinance answering questions from council members. Council Member Crim made the motion to accept the ordinance with the exception of changing the four (4) acres to three (3) acres. Council Member Geren seconded the motion. Motion failed. Aye 3 NAY 3 ABSTAIN 0 Council Member Deragon made the motion to approve with no exceptions. Council Member Green seconded that motion. Discussion on the exceptions continued. Fire Chief, Lary Bridges would like to see the exception for allowing the fire department to have training bums left in the ordinance. Council Member Deragon said he would amend the motion to allow the Fire Department to do training bums. Discussion on the large lot owners being able to burn and the different exceptions continued. Council Member Deragon withdrew his motion. Council Member Green made the motion to table this item till the next meeting. Council Member Decagon seconded the motion. Motion passes. AYE 5 NAY 1(CM Crim) ABSTAIN 0 13. Consider/Discuss/Action regarding an ordinance Repealing Ordinance No. 2002-41 regarding the regulation of garage sales and adopting regulations regarding the conduct of garage sales; sign locations; establishing a fee. City Manager, Kenny Jenks led the discussion and noted some changes to the ordinance in council's packet and answered questions from council members. Council Member Deragon made the motion to approve the ordinance as written. Council Member Green seconded the motion. Motion failed. AYE 3 NAY 3(CM Anderson, Geren and Crim) ABSTAIN 0 Council Member Deragon made the motion to approve with no fee. Council Member Green seconded the motion. Motion failed. AYE 3 NAY 3(CM Anderson, Geren and Crim) ABSTAIN 0 Council Member Anderson made the motion to approve the ordinance with out the fee and increase the number of garage sales to four (4) a year. Consider/Discuss/Action regarding amending Section 1 of Ordinance No. 2001-01 (Sign Regulations) by clarifying that the Regulation of Garage Sale Signs is stated in the Garage Sale Ordinance. 15. Consider/Discusa/Action on adopting a dress code for City Council Members. Mayor Pelham led the discussion to have appropriate dress code for all boards and commissions and city council. Council Member Deragon made a motion to pass the suggested attire. Council Member Geren seconded the motion. City Attorney, Clark McCoy suggested that an ordinance be put together to address the issues and Council pass the ordinance. Council Member Deragon made a motion to have an ordinance draft to address the dress code of council, boards and commissions. Council Member Geren seconded the motion. Motion passes. AYE 5 NAY 1(CMCrim) ABSTAIN 0 16. Staf Reports: a. Status of City Hal► Annex — parch lights, exit light, working with engineers on site plan for parking lot b. Gas Line Status — no status report from Llano at this time C. Status of FM 455/CR 367 (Ferguson Pkwy) intersection — connected to FM 455; we have made complaints to the contractor about the roughness of the road; we do not have a time line from TXDOT for FM 455 d. Park Board Ordinance — there are issues with this ordinance and it will be brought back to council at a future meeting e. Posted Meeting Room Attire/Rules for Eating/Driokiug — Hiles are being handed out to any one using the meeting room 17. Future Agenda Consideration. CM Anderson — increasing the building standards for insulation from R38 to R49 and radiant harriers. CM Green — possible new location for Police Department and lifting of the water restrictions. Mr. Pierce water deposit and trash service items. CM Geren — addressing Mr. King's situation and taking care of promises made to him. CM Crim —None CM Deragon — Water Conservation/Signs to encourage.
