A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING THE SUBMISSION OF
AN APPLICATION TO THE TEXAS NATURAL RESOURCE CONSERVATION
COMMISSION TO AMEND THE CORPORATION'S CERTIFICATE OF CONVENIENCE
AND NECESSITY; PROVIDING FOR SEVERABILITY; REPEALING CONFLICTING
RESOLUTIONS; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Anna (`City") desires to amend its certificate of
convenience and necessity (`CCN') number 12976 for the provision of water service; and
WHEREAS, the City has the capacity and ability to serve the proposed service area; and
WHEREAS, in order to serve its existing and potential customers, the City Council finds it in the
City's best interest to amend its CCN to encompass all potential customers; and
WHEREAS, the City Council authorizes the City Administrator to submit an application to amend
the City's CCN to the Texas Natural Resource Conservation Commission ("TNRCC").
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA,
TEXAS:
SECTION 1. The recitals contained in the preamble of this resolution are determined to be true
and correct and are hereby adopted as a part of this resolution.
SECTION 2. The City Council hereby authorized the City Administrator to take all actions
necessary to amend its water CCN No. 12976 with the TNRCC. All actions taken to amend the
CCN hereby authorized and approved.
SECTION 3. Severability. It is hereby declared that the sections, paragraphs, sentences,
clausesI and phrases of this resolution are severable and, if any phrase, clause, sentences,
paragraph, or section of this resolution shall be declared unconstitutional or invalid by the valid
judgment or decree of any court of competent jurisdiction, such unconstitutionality or invalidity
shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of
this resolution, because the same would have been enacted by the city council without the
incorporation of any such unconstitutional phrase, clause, sentence, paragraph, or section.
SECTION 4. All resolutions and parts thereof in conflict herewith are hereby expressly repealed
insofar as they conflict herewith.
SECTION 5. Effective Date. This resolution shall take effect immediately from and after its
adoption and it is accordingly so resolved.
