Item No. 2. City Council Agenda Staff Report Meeting Date: 3/14/2017 Y{OUR} HOMETOWN I'_TH:Ih117_111194Ly1A Briefing/Discussion regarding the proposed 2017 Collin County Bond Program. (City Manager) SUMMARY: On March 1 st, Mayor Crist, Joseph Johnson and I attend a meeting with officials from Collin County regarding a future road bond program. Collin County is planning to call for a bond election in November of this year to fund primarily planning, design and right-of-way acquisition for several new limited access freeways that the County believes are necessary to accommodate growth in Collin County. They have not determined if funding for any additional roads will be included in the bond, and have indicated that the limited access freeways are the priority. At this point it is not clear that funding for Ferguson Parkway or any other local priority would be included in the bond program. Staff strongly believes that major thoroughfare projects connecting to limited access roads should be considered a critical component of this potential bond issue. While we agree that long-term planning for limited access roadways is important, major City thoroughfare projects that connect to the limited access roads have immense regional benefit and could relieve traffic congestion today. City Council Agenda Staff Report Meeting Date: 3/14/2017 q{OU,} HOMETOWN AGENDAITEM: Briefing/Discussion regarding House Bill 1427 and Senate Bill 2. (City Manager) SUMMARY: HB 1427 The City of The Colony has been involved in a case at the Public Utility Commission involving an appeal by Brazos Electric Cooperative ("Brazos") and CoSery of the City's land use and zoning ordinances. The cooperatives appealed the Colony's ordinance after the City refused to grant the cooperatives a special use permit to build a substation on a certain piece of land. The City's zoning ordinance prohibits certain land use activities in the property's zone, including substation use. A hearing on the merits was held in September and the judge issued a Proposal for Decision ("PFD") in December. The PFD concluded the Colony's ordinance and denial of the special use permit violates Public Utility Regulatory Act ("PURA") Section 41.005, which prohibits a municipality from regulating a cooperative's rates, services, or operations except with regards to operations only to the extent necessary to protect health, safety, or welfare. A final order has not yet been issued, but at an open meeting in February, the PUC decided the Colony's ordinance violates the PURA because it regulates the services of Brazos and CoServ. The Commissioners also found the ordinance violates PURA's pervasive regulatory scheme over transmission service. Once the final order is issued, parties will have 25 days to file a motion for rehearing. Meanwhile, the City of The Colony has been exploring legislative options. HB 1427 (full text) by Rep. Fallon would amend the law to clarify that a city is not prohibited from enforcing its zoning and other land use regulations including a specific use permit except in very limited circumstances. The Colony is very interested in getting as much support as they can. Obviously, this is an issue that may impact other cities including the City of Anna. Attached is a resolution for those cities that would like to formally show their support. SB 2 Senate Bill 2, introduced by Senator Bettencourt, is of primary importance to cities, and is one of the most watched bills by the Texas Municipal League (TML)this legislative session. In summary, the bill would: 1. lower the property tax rollback rate from eight percent to four percent, with an exception for a taxing unit located in an area declared a disaster area by the governor or president of the United States during the current tax year; 2. require a taxing unit to hold a ratification election on the November uniform election date of the applicable year in order to adopt a tax rate that exceeds the four -percent rollback rate (as opposed to current law, which only requires an election if a petition is received from the citizens); and 3. make numerous calendar changes to the property tax appraisal, collection, and ratesetting process in order to have property tax ratification elections on the November uniform election date. WHEREAS, House Bill 1427 (2017), a copy of which is attached hereto as Exhibit A, proposes to amend Section 41.005 of the Texas Utilities Code, also referred to as the Public Utility Regulatory Act ("PURA"); and WHEREAS, Section 41.005 of the Texas Utilities Code currently provides in part that a municipality may not directly or indirectly regulate the rates, operations, and services of an electric cooperative except, with respect to operations, to the extent necessary to protect the public health, safety, or welfare; and WHEREAS, municipal zoning authority is contained in Chapter 211 of the Texas Local Government Code; and WHEREAS, Section 211.001 of the Texas Local Government Code states the following: "The [zoning] powers granted under this subchapter are for the purpose of promoting the public health, safety, morals, or general welfare and protecting and preserving places and areas of historical, cultural, or architectural importance and significance;" and WHEREAS, an inline electrical substation has been defined by the rules of the Public Utility Commission of Texas ("PUC") to be an electrical substation constructed within one (1) mile of an existing electrical transmission line; and WHEREAS, the Public Utility Commission of Texas currently does not control where an electric cooperative may locate an inline electrical substation; and WHEREAS, the Public Utility Commission of Texas currently does not require a certificate of convenience and necessity ("CCN") to be held by an electric cooperative for the placement and location of an inline electrical substation; and WHEREAS, electrical cooperatives' and the PUC's view of Section 41.005 of the Texas Utilities Code and PURA is that electrical cooperatives are the first, only, and final decision - maker on the placement and location of inline electrical substations; and 7295337.4 1 WHEREAS, electrical cooperatives' and the PUC's view of Section 41.005 of the Texas Utilities Code and PURA results in a regulatory vacuum with no oversight by the State of Texas, or any county or municipality as to the placement and location of inline electrical substations; and WHEREAS, the City Council of the City of , Texas, believes Section 41.005 of the Texas Utilities Code currently preserves the authority for the City, through its zoning ordinance, to regulate the location of an inline electrical substation of an electric cooperative, provided the City does not use its zoning powers to exclude the electric cooperative from the City; and WHEREAS, to conclude otherwise leaves the citizens of the State of Texas to the whims of electrical cooperatives on the placement and location of inline electrical substations with no venue for contesting such placement and no oversight by the State of Texas or the impacted local municipality. Section 41.005, Utilities Code, is amended to 6 read as follows; 7 Sec. 41.005. LIMITATION ON MUNICIPAL AUTHORITY. (a) 8 Notwithstanding any other provision of this title, a municipality 9 may not directly or indirectly regulate the rates, operations, and 10 services of an electric cooperative, except, with respect to 11 operations, to the extent necessary to protect the public health, 12 safety, or welfare. 13 (b) This section does not prohibit a municipality from 14 making a lawful charge for the use of public rights -of -way within 15 the municipality as provided by Section 182.025■ Tax Code, and 16 Section 33.008 of this code. A RESOLUTION OF THE CITY OF , TEXAS, IN OPPOSITION TO A REVENUE CAP AND LEGISLATIVE INTERFERENCE WITH LOCAL SERVICES. WHEREAS, bills have been introduced to cap the amount of property tax revenue cities can collect each year in a misguided effort to reduce the property tax burden on homeowners and businesses; and WHEREAS, currently, if a Texas city increases property tax collections by more than eight percent over the previous year, voters can petition for an election to rollback the increase; and WHEREAS, bills have been introduced to replace that eight percent "rollback rate" with a hard cap of four percent and require mandatory elections on an increase over four percent — all with the false claim that this would provide property tax relief, and WHEREAS, according to the state comptroller's latest survey of property tax rates in 963 cities in Texas, 56 percent of cities raised their property taxes by less than four percent from 2014 to 2015 and 27 percent of cities actually reduced their property taxes; and WHEREAS, that means property owners in at least 547 Texas cities would have seen no reduction in their city property taxes if the four percent cap had been in effect; and WHEREAS, while the savings to individual taxpayers are very small or even non-existent, a four percent cap could represent a loss in vital city services; and WHEREAS, cities collect just 16 percent of the property taxes levied in Texas, and most of the property taxes paid by Texans (55 percent) go to school districts; and WHEREAS, according to the comptroller's report, the total amount of property taxes collected by cities rose by 3.61 percent between 2014 and 2015, while school district tax collections rose by more than twice that rate or 7.72 percent; and WHEREAS, school property taxes have been rising because the legislature continues to reduce the state's share of funding for schools, which forces districts to get more revenue from property taxes. That the City Council of the City of , Texas, is OPPOSED to the legislative imposition of a revenue cap and legislative interference with local services; and 3. Consider/Discuss/Action regarding a Resolution authorizing the City Manager to execute a Texas Risk Reduction Program Restrictive Covenant for a 0.792 acre tract of land located on S. Powell Parkway. (City Manager) In connection with the purchase of the Anna Grain property last year, the City hired a firm to perform a comprehensive environmental survey of the property. On June 14 last year, our environmental engineer presented a brief summary of the findings and an outline of the proposed remediation strategy. The study found elevated levels of arsenic in the soil in the suspected area of a former cotton gin. While the levels exceed the EPA standard for residential use, they did not exceed the standard for commercial use. Based on the recommendation of our environmental engineer, the City submitted a corrective action plan to the TCEQ that included a proposal to deed restrict the affected property for commercial uses. On February 16, 2017 the TCEQ issued a letter approving the City's proposed corrective action plan to deed restrict the portion of the property that is affected by elevated levels of arsenic. The attached Resolution would authorize the City Manager to execute the Texas Risk Reduction Program Restrictive Covenant attached as Exhibit 1 to the Resolution. Our environmental engineer will be at the meeting to answer any questions the Council may have. Chalmers Survey, Abstract No. 0233 and the S. Craft Sr. Survey No. 0165. The area contains 26 parcels of property with 5 single family homes, 18 manufactured homes, and two commercial buildings under construction and is bounded on the south by the Sam Rayburn Memorial Hwy. and is traversed by F.M. 2862 and County Road 526. The north Boundary is County Road No. 525. The Resolution would initiate or begin annexation proceedings of the area. The City will schedule two public hearings that will be held during the regular City Council Meetings on April 11 th and April 25th. During the first public hearing, Staff will present a plan that will explain how the city will fulfill its obligation to extend full municipal services to the properties being annexed. A final vote on the annexation would be scheduled on May 23rd. Prior to annexing properties that are appraised for property tax purposes as land for agricultural, wildlife management use, or as timber land (as defined in Subchapter C, D, or E Chapter 23, Tax Code) the City is required to offer to make a development agreement with the landowner. Such a development agreement would: 1. guarantee the continuation of the extraterritorial (outside the city limits) status of the property for a period of time; and 2. authorize the enforcement of all regulations and planning authority of the city that do not interfere with the use of the property for agriculture, wildlife management, or timber. The City could elect to proceed with annexation of property with a qualifying tax exemption if the owner declines a development agreement offer extended by the City. The Council may elect to extend the same development agreement offer to the owners of properties that do not have a qualifying tax exemption. If the exchange is transacted, the land currently owned by the City of Anna would become private property and the tract acquired by the City of Anna would be used for municipal park purposes. Whenever land that is designated for park purposes is sold, State law requires that a proposition approving the sale be approved by the majority of voters at an election. The attached Ordinance amends Ordinance No. 739-2017, which ordered a general election to be held on May 6, 2017 to order an additional special election on a measure to allow for the exchange of real property for municipal park purposes. The proposition on the election ballot will substantially state as follows: "FOR or AGAINST authorizing the exchange of approximately acres of land owned by the City of Anna in Natural Springs Park for a privately owned acres of nearby land lying adjacent to said Natural Springs Park to be used for municipal park purposes." (Maurice Schwanke) SUMMARY: In December last year Staff met with Mr. Steven Copely with the TxDOT Dallas District office to discuss funding opportunities through the TxDOT green ribbon program fund. The TxDOT green ribbon program is a cooperative (city/TxDOT) program that funds landscape improvements along TxDOT roadways. The primary goal of the program is to establish a higher level of visual appeal along the State highway corridors through landscape improvements. The program operates on the premise that TxDOT will fund certain landscape enhancements through an Agreement with a sponsoring local government to maintain the landscape enhancements upon completion. Cities are allowed to include limited monument signage as part of the enhancements, however, any monumentation would be funded by the city. Participation in this program would assist the City with "Improving the Curb/Aesthetic Appeal of our Community", one of our Strategic Goals. Several current and future roadway construction projects will be eligible for landscape enhancements funded through the green ribbon program including the new FM 455 median, and areas around the new bridges/interchanges at US 75 and the Collin County Outer Loop, FM 455, future Rosemond Parkway, and CR 371 (Mantua) Green ribbon funds will be available in the 2018 fiscal year (starts in September of 2017) to provide landscape enhancements to the FM 455 median. Green ribbon funds would be available for areas around the new bridges and interchanges on US 75 when the US 75 reconstruction project is complete. In December Staff issued a Request for Proposals (RFP) for landscape architecture services to assist the City in developing a schematic design for green ribbon projects along FM 455 and US 75. Five (5) firms responded and after review of the various proposals, Staff is recommending the selection of Pacheco Koch to provide the landscape architecture services outlined in the RFP. Based in the DFW area, Pacheco Koch offers a wide range of services including civil engineering, land surveying and landscape architecture. Wade Peterson is the director of landscape architecture for the firm and has significant experience with the green ribbon program. The scope of services outlined in the proposed contract include: • the creation of a master plan for median and freeway (US 75) interchange landscape improvements for interchanges within the city limits, and median enhancements for FM 455 between US 75 and SH 5. ($32,000) 9 design standards for future local median divided roadways ($2500) • a three-dimensional renderings and modeling of the green -ribbon project to use in public presentations and to local media. ($7000) • design services to develop monuments and signage for the city along the US 75 and in the median at FM 455. ($16,000) The total cost of all services is $57,500. Funds are available in the Roadway Impact Fee (district #1) account to pay for most of the project including: the master plan, 3-D modeling, and monument and way -finding design. The cost of the design standards for future median divided roadways ($2500) would be assigned to the Street department engineering budget. Staff would bring a budget amendment to the City Council later this year to properly assign the cost of this project to the various funds. If the City's request for green ribbon funds is approved, we would anticipate entering into another contract with Pacheco Koch for the development of full construction plans for any funded project. The cost of developing construction plans is not covered by the green ribbon funds and would have to be funded by the City. ARTICLE 4 COMPENSATION A. BILLING AND PAYMENT: For and in consideration of the professional services to be performed by LANDSCAPE ARCHITECT herein, OWNER agrees to compensate LANDSCAPE ARCHITECT the amounts and in the manner described in the Landscape Architecting Proposal which is attached hereto as Exhibit "A" and made a part of this Agreement. Nothing contained in this Article shall require OWNER to pay for any work which is unsatisfactory, as reasonably determined by the City Manager or his designee, or which is not submitted in compliance with the terms of this Agreement. OWNER shall not be required to make any payments to LANDSCAPE ARCHITECT when LANDSCAPE ARCHITECT is in default under this Agreement. It is specifically understood and agreed that LANDSCAPE ARCHITECT shall not be authorized to undertake any work pursuant to this Agreement which would require additional payments by OWNER for any charge, expense, or reimbursement above any maximum not -to -exceed fee as stated within the Landscape Architect Proposal (Exhibit "A") without first having obtained written authorization from OWNER. PAYMENT: If OWNER fails to make payments due LANDSCAPE ARCHITECT for services and expenses within 60 days after receipt of LANDSCAPE ARCHITECT's undisputed statement thereof, the amounts due LANDSCAPE ARCHITECT will be increased by the rate of one percent (1 %) per month from the said 60t" day, and, in addition, LANDSCAPE ARCHITECT may, after giving seven days' written notice to OWNER, suspend services under this Agreement until LANDSCAPE ARCHITECT has been paid in full all amounts due for services, expenses, and charges, provided, however, nothing herein shall require OWNER to pay the late charge of one percent (1 %) set forth herein if OWNER reasonably determines that the work is unsatisfactory, in accordance with this Article 4, "Compensation." ARTICLE 5 INDEPENDENT CONTRACTOR LANDSCAPE ARCHITECT shall provide services to OWNER as an independent contractor, not as an employee of the OWNER. Nothing in this Agreement shall be construed to create a liability to any person who is not a party to this Agreement, and nothing herein shall waive any of the parties' defenses, both at law or equity, to any claim, cause of action, or litigation filed by anyone not a party to this Agreement, including the defense of governmental immunity, which defenses are hereby expressly reserved. ARTICLE 7 INSURANCE During the performance of the services under this Agreement, LANDSCAPE ARCHITECT shall maintain the following insurance with an insurance company licensed to do business in the State of Texas by the State Insurance Commission or any successor agency that has a rating with Best Rate Carriers of at least an A- or above: A. Comprehensive General Liability Insurance with bodily injury limits of not less than $500,000 for each occurrence and not less than $500,000 in the aggregate, and with property damage limits of not less than $100,000 for each occurrence and not less than $100,000 in the aggregate. B. Automobile Liability Insurance with bodily injury limits of not less than $500,000 for each person and not less than $500,000 for each accident, and with property damage limits of not less than $100,000 for each accident. C. Worker's Compensation Insurance in accordance with statutory requirements, and Employers' Liability Insurance with limits of not less than $100,000 for each accident. D. Professional Liability Insurance with limits of not less than $1,000,000 annual aggregate. E. LANDSCAPE ARCHITECT shall furnish insurance certificates or insurance policies at OWNER's request to evidence such coverages. The insurance policies shall name PROFESSIONAL SERVICES AGREEMENT FOR LANDSCAPE ARCHITECT SERVICES Page 3 of 7 OWNER as an additional insured on all such policies, and shall contain a provision that such insurance shall not be canceled or modified without 30 days' prior written notice to OWNER and LANDSCAPE ARCHITECT. In such event, LANDSCAPE ARCHITECT shall, prior to the effective date of the change or cancellation, serve substitute policies furnishing the same coverage. ARTICLE 8 TERMINATION OF AGREEMENT A. Notwithstanding any other provision of this Agreement, either party may terminate by giving 30 days' advance written notice to the other party. B. If the Agreement is terminated prior to completion of the services to be provided hereunder, LANDSCAPE ARCHITECT shall immediately cease all services and shall render a final bill for services to OWNER within 30 days after the date of termination. OWNER shall pay LANDSCAPE ARCHITECT for all services properly rendered and satisfactorily performed and for reimbursable expenses to termination incurred prior to the date of termination, in accordance with Article 5 "Compensation." Should OWNER subsequently contract with a new LANDSCAPE ARCHITECT for the continuation of services on the Project, LANDSCAPE ARCHITECT shall cooperate in providing information. LANDSCAPE ARCHITECT shall turn over all documents prepared or furnished by LANDSCAPE ARCHITECT pursuant to this Agreement to OWNER on or before the date of termination, but may maintain copies of such documents for its use. ARTICLE 9 RESPONSIBILITY FOR CLAIMS AND LIABILITIES Approval by the OWNER shall not constitute, nor be deemed a release of the responsibility and liability of LANDSCAPE ARCHITECT, its employees, associates, agents, and subcontractors, for the accuracy and competency of their designs or other work; nor shall such approval be deemed to be an assumption of such responsibility by OWNER for any defect in the design or other work prepared by LANDSCAPE ARCHITECT, its employees, subcontractors, agents, and LANDSCAPE ARCHITECTs. ARTICLE 10 NOTICES All notices, communications, and reports required or permitted under this Agreement shall be personally delivered or mailed to the respective parties by depositing same in the United States mail to the address shown below, certified mail, return receipt requested, unless otherwise specified herein. ARTICLE 11 ENTIRE AGREEMENT This Agreement constitutes the complete and final expression of the agreement of the parties, and is intended as a complete and exclusive statement of the terms of their agreements, and supersedes all prior or contemporaneous offers, promises, representations, negotiations, discussions, communications, and agreements which may have been made in connection with the subject matter hereof. ARTICLE 12 SEVERABILITY If any provision of this Agreement is found or deemed by a court of competent jurisdiction to be invalid or unenforceable, it shall be considered severable from the remainder of this Agreement and shall not cause the remainder to be invalid or unenforceable. In such event, the parties shall reform this Agreement to replace such stricken provision with a valid and enforceable provision which comes as close as possible to expressing the intention of the stricken provision. ARTICLE 13 COMPLIANCE WITH LAWS LANDSCAPE ARCHITECT shall comply with all federal, state, and local laws, rules, regulations, and ordinances applicable to the work covered hereunder as they may now read or hereinafter be amended. ARTICLE 14 DISCRIMINATION PROHIBITED In performing the services required hereunder, the LANDSCAPE ARCHITECT shall not discriminate against any person on the basis of race, color, religion, sex, national origin or ancestry, age, or physical handicap. PROFESSIONAL SERVICES AGREEMENT FOR LANDSCAPE ARCHITECT SERVICES Page 5 of 7 ARTICLE 15 PERSONNEL A. LANDSCAPE ARCHITECT represents that it has or will secure, at its own expense, all personnel required to perform all the services required under this Agreement. Such personnel shall not be employees or officers of, or have any contractual relations with OWNER. LANDSCAPE ARCHITECT shall inform OWNER of any conflict of interest or potential conflict of interest that may arise during the term of this Agreement. B. All services required hereunder will be performed by LANDSCAPE ARCHITECT or under its supervision. All personnel engaged in work shall be qualified, and shall be authorized and permitted under state and local laws to perform such services. ARTICLE 16 ASSIGNABILITY LANDSCAPE ARCHITECT shall not assign any interest in this Agreement, and shall not transfer any interest in this Agreement (whether by assignment, novation, or otherwise) without the prior written consent of OWNER. ARTICLE 17 MODIFICATION No waiver or modification of this Agreement or of any covenant, condition, or limitation herein contained shall be valid unless in writing and duly executed by the party to be charged therewith, and no evidence of any waiver or modification shall be offered or received in evidence in any proceeding arising between the parties hereto out of or affecting this Agreement, or the rights or obligations of the parties hereunder, and unless such waiver or modification is in writing and duly executed; and the parties further agree that the provisions of this section will not be waived unless as set forth herein. ARTICLE 18 MISCELLANEOUS A. Venue of any suit or cause of action under this Agreement shall lie exclusively in Collin County, Texas. This Agreement shall be construed in accordance with the laws of the State of Texas. B. For the purpose of this Agreement, the key persons who will perform most of the work hereunder shall be However, nothing herein shall limit LANDSCAPE ARCHITECT from using other qualified and competent members of its firm to perform the services required herein. C. LANDSCAPE ARCHITECT shall commence, carry on, and complete any and all projects with all applicable dispatch, in a sound, economical, and efficient manner and in accordance with the provisions hereof. D. OWNER shall assist LANDSCAPE ARCHITECT by placing at LANDSCAPE ARCHITECT's disposal all available information pertinent to the Project, including previous reports, any other data relative to the Project, and arranging for the access thereto, and make all provisions for LANDSCAPE ARCHITECT to enter in or upon public and private property as required for LANDSCAPE ARCHITECT to perform services under this Agreement. E. LANDSCAPE ARCHITECT shall at all times maintain OWNER'S confidential or proprietary information in confidence and shall disclose same to third parties only as specifically instructed by OWNER. Any disclosure of privileged or confidential information by OWNER to LANDSCAPE ARCHITECT is in furtherance of OWNER's purposes and is not intended to and does not waive any privileges that may exist with regard to such information. F. The captions of this Agreement are for informational purposes only, and shall not in any way affect the substantive terms or conditions of this Agreement. SCOPE OF SERVICES Based on our preliminary discussions and review of the information received to date, the following is our perception of the services to be provided by Pacheco Koch for the referenced project. Each category is described and priced separately for you to be able to determine specific needs and/or phasing of design services as needed. Basic Planning Services: TEMPORARY BASE FILE CREATION: For purposes of planning early phases of the design, Pacheco Koch will develop a schematic working base file from Lidar, aerial photos, and construction document from current construction. Following the Master Plan phase of work, it is anticipated that additional field survey work will be required by TxDOT to submit complete Green Ribbon projects for construction and State letting. Included in this item: • Gathering of three forms of data and combining them in their various formats to create a working base file, for the area shown in Exhibit "A”. Included in this item: ■ Three (3) meetings with City Staff and any stakeholders. Pacheco Koch will prepare for the meeting with graphics, an agenda, and provide meeting notes afterwards. These meetings are to show progress and to receive comments at the following stages: o Visibility Analysis o Concepts and Precedents o Preferred Option ■ A "Visibility Analysis" will be performed on all areas where potential green ribbon funding could be spent, prioritizing areas that are most highly visible from the most number of places. This analysis will be documented on a plan graphic. ■ Two (2) broad concepts of potential design styles for both FM 455, and US 75 interchanges. Concepts will include a plan, precedent images, proposed material families, and a high level estimate of costs. ■ A Preferred Option plan will be prepared from comments received from City staff and their chosen stakeholders on the two concepts and precedents produced earlier. This deliverable will be a plan that will define limits of proposed improvements, define major materials chosen for the plan and a concept level estimate of probable construction cost that can be used to identify a Phase 1 project. ■ Adaptation of the documents produced in this Master Plan phase to assist the city in officially applying for the funding from TxDOT. LANDSCAPE MEDIAN STANDARDS: Pacheco Koch will provide prototype median design standards for inclusion in the City of Anna Public Works Standards. The standard will be sufficient to direct in requirements for median landscapes. Optional Planning Services: MODELING AND RENDERING SERVICES: If requested, Pacheco Koch will provide three dimensional renderings and modeling to use in presentations to City Council, local media, or public meetings. Included in this item: • Color rendered digital model of at least 1,000 linear feet of FM 455 showing all proposed improvements. • Color rendered digital model of one (1) interchange on US 75 showing all proposed improvements. ■ One (1) meeting with city staff to show a draft and receive comments. ■ CD of the digital files for the City to use as it sees fit. Not included in this item: ■ Multiple concepts. This will be modeled based on the approved concept. This is for schematic design only until the City can determine the quantity, size and extent of the desired improvements. Construction document fees for this work can be determined at that time. Included in this item: ■ Two (2) design concepts for signs and iconic elements for preferred selection by the City. Incorporation of the proposed monument with materials, colors and scale identified. ■ Plan, section and elevation details of the proposed monument with recommendation for location in relation to the monument itself, both horizontally and vertically. Not included in this item: Structural, electrical, and detailed construction detailing for this item. That can be provided as an additional service when scope has been further defined. Construction Plan Services: (Provided for segments funded by the errant and any City match) Since the funding total has not been determined, this section is to help the City budget for detail design of whatever Planning Services are selected to move into detailed design and construction. Below demonstrates the proposed minimal scope of services Pacheco Koch suggests for any project moving into construction documents in the TxDOT format. TOPOGRAPHIC SURVEY: Pacheco Koch will perform an on the ground survey of the property under the direct supervision of a Registered Professional Land Surveyor. Included in this item: ■ Location of permanent improvements on, and immediately adjacent to, the site. ■ Spot elevations on a 50-foot grid. ■ Contours on one foot intervals. ■ Top of curb and gutter elevations for paving on, and immediately adjacent to, the site. ■ Locations, common name and trunk diameter of trees over 6-inches in caliper or the outline of heavily wooded areas. ■ Location of visible utilities and appurtenances. ■ Location and sizes of underground utilities based on available record information. ■ Pacheco Koch will graphically plot, if any, the Special Flood Hazard Area from the Flood Insurance Rate Map (FIRM), published by Federal Emergency Management Agency (FEMA), for this area. LANDSCAPE ARCHITECTURE: Pacheco Koch will provide plans for the general requirements sheets and the hardscape elements required for the project required in the TxDOT format. Included in this item: • Cover sheet and Index of Drawings • Summary of Quantity and Pay Item Sheets ■ TxDOT project general notes and general details sheets ■ Traffic Control, Erosion Control, SWPPP, EPIC sheets. • Grading, drainage and erosion control structures ■ Dimensional control plans for mow curbs, ornamental cobble or walls. ■ Construction details. LANDSCAPE PLANTING PLANS: Pacheco Koch will provide a Landscape Planting Plan that consists of selection and location of ornamental plantings, street or site shade trees, turf, mulches and associated items. Included in this item: ■ Planting plans, details and schedules in TxDOT format. LANDSCAPE IRRIGATION PLANS: Pacheco Koch will provide a Landscape Irrigation Plan that consists of a fully automated irrigation system to service plantings on the site as required. Included in this item: ■ Irrigation plans, details, calculations and schedules in TxDOT format. Not included in this item: ■ Non -potable water source or water harvesting. Should this be required, it can be done as an additional service. LANDSCAPE CONSTRUCTION ADMINISTRATION: Pacheco Koch will provide limited Construction Administration services related to the work shown on the Landscape Planting and Irrigation Plans. A representative will process shop drawings and product submittals, respond to RFIs, and issue supplemental instructions if required related to the work shown on the Landscape Architecture, Planting and/or Irrigation Plans provided by Pacheco Koch. Submittals not required by the contract documents or not related to plans developed by the landscape architect will not be reviewed. At the Client's request, a representative will attend up to three (3) Owner/Architect/Contractor (OAC) project coordination meetings during construction. At the request of the Owner, Pacheco Koch will visit the site at critical junctures during the course of site construction up to five (5) times. Recommended times for site visits could include: ■ Paving mockups and site formwork/reinforcing. ■ Testing of the irrigation main line and landscape drainage structures. T TxDOT Green Ribbon Program Landscape Architect Services 6 Melissa, TX REFERENCE: Jason Little City of Melissa 972.838.2338 Through its relationship with the Dallas District landscape architect from TxDOT, Pacheco Koch was able to get $2,000,000 in Green Ribbon funding to enhance the interchange of US 75 Central Expressway and State Highway 121 and the entry to the City of Melissa. In exchange for the larger than normal funding allotment, the City and Pacheco Koch have developed a project that is a model of sustainability in addition to providing superior aesthetics. Ornamental stone mulch and strategically placed gabions filter storm water runoff in multiple locations prior to being captured in a cistern, then re- used for irrigating the project. Plantings are of native varieties that require little irrigation, if any, when established, and were specifically chosen to support the growing "Pollinator Pathway" initiative for the Monarch Butterfly. The drainage swales and detention areas are planted with native grasses that thrive in such a setting, and perform the important function of limiting erosion and filtering storm water runoff. The City added funding to construct monumental signs and iconic elements to act as a gateway and identifier to the City of Melissa. Plans and specifications are nearly complete and a tentative bid date of July 2017 is anticipated.
