RESOLUTION NO. 204-90
A RESOLUTION AUTHORIZING THE SUBMISSION OF AN
APPLICATION FOR (;RANT ASSISTANCE UNDER TIIE 1990
TEXAS COMMUNITY DEVELOPMENT PROGRAM (TCDP),
AUTIIOIUZING A LOCAL MATCH, AND AUTHORIZING THE
MAYOR TO ACT AS TIIE CITY'S REPRESENTATIVE IN ALL
l\tATTEHS PERTAINING TO THE CITY'S PARTICIPATION IN
THE TEXAS COMMUNITY DEVELOPMENT PROGRAM.
\Vhereas, the City desires to develop a viable community, including decent housing, a
suitable living environment and/or expanding economic opportunities, principally for
persons of low to moderate income; and
Whereas, certain conditions exist which represent a threat to public health and safety; and
Whereas, it is necessary and in the best interests of the City of Anna to avail itself of the
1990 Texas Community Development Planning Program;
NO\\' THEREFORE, BE IT RESOLVED BY TIIE GOVERNING BODY OF
THE CITY OF ANNA, TEXAS:
(I) That the City of Anna undertake a program to prepare the following described
planning efforts:
Basic Studies (mapping, housing, land use, population); Street Conditions Study;
Water Study; Wastewater Study; Drainage Study; Capital Improvements Program;
Subdivision Regulations
(2) That a Texas Community Development Program application for Planning/Capacity
Building Fund is hereby authorized to be filed on behalf of the City with the Texas
Department of Commerce and any other appropriate agencies as defined in the
regulations.
(3) That the City Council directs and designates the Mayor as the City's chief executive
officer and authorized representative to act in all matters in connection with this
application and the City's participation in the 1990 Texas Community Development
Program.
(4) That the City commits itself, if funded by the Texas Community Development
Program, to appropriate $1,660 as matching funds and as a demonstration of its
local support of the planning project.

CERTIFICATIONS
I CERTIFY WITH RESPECT TO THE EXPENDITURE OF FUNDS PROVIDED UNDER THIS
CONTRACT BY THE CITY OF ANNA , THAT;
~~~~~~~-,--,---~~~~~~~~~~ (LOCALITY)
(1) IT WILL MINIMIZE DISPLACEMENT OF. PERSONS AS A RESULT OF ACTIVITIES
ASSISTED WITH SUCH FUNDS;
(2) THE PROGRAM WILL BE CONDUCTED AND ADMINISTERED IN CONFORMITY WITH
TITLE VI OF THE CIVIL RIGHTS ACT OF 1964 (42 USC 2000d et seq.) AND
THE FAIR HOUSING ACT (42 USC 3601-20), AND THAT IT WILL
AFFIRMATIVELY FURTHER FAIR HOUSING, AS SPECIFIED BY DEPARTMENT;
(3) IT WILL PROVIDE FOR OPPORTUNITIES FOR CITIZEN PARTICIPATION,
HEARINGS AND ACCESS TO INFORMATION WITH RESPECT TO ITS COMMUNITY
DEVELOPMENT PROGRAMS AND IT IS FOLLOWING DEPARTMENT'S TEXAS
COMMUNITY DEVELOPMENT PROGRAM CITIZEN PARTICIPATION PLAN;
(4) IT WILL NOT ATTEMPT TO RECOVER ANY CAPITAL COSTS OF PUBLIC
IMPROVEMENTS ASSISTED IN WHOLE OR IN PART WITH SUCH FUNDS BY
ASSESSING ANY AMOUNT AGAINST PROPERTIES OWNED AND OCCUPIED BY
PERSONS OF LOW AND MODERATE INCOME, INCLUDING ANY FEE EHARGED OR
ASSESSMENT MADE AS A CONDITION OF OBTAINING ACCESS TO SUCH PUBLIC
IMPROVEMENTS UNLESS: (A) SUCH FUNDS ARE USED TO PAY THE PROPORTION
OF SUCH FEE OR ASSESSMENT THAT RELATED TO THE CAPITAL COSTS OF SUCH
PUBLIC IMPROVEMENTS . THAT ARE FINANCED FROM REVENUE SOURCES OTHER
THAN SUCH FUNDS; OR (B) FOR PURPOSES OF. ASSESSING ANY AMOUNT AGAINST
PROPERTIES OWNED AND OCCUPIED BY PERSONS OF LOW AND MODERATE INCOME
WHO ARE NOT PERSONS OF VERY LOW INCOME, CONTRACTOR CERTIFIES THAT IT
LACKS SUFFICIENT FUNDS UNDER THIS CONTRACT TO COMPLY WITH THE
REQUIREMENTS OF CLAUSE (A);
(5) IN THE EVENT THAT DISPLACEMENT OF RESIDENTIAL DWELLINGS WILL OCCUR
IN CONNECTION WITH A PROJECT ASSISTED WITH TCDP FUNDS, IT WILL
FOLLOW A RESIDENTIAL ANTIDISPLACEMENT AND RELOCATION ASSISTANCE
PLAN, AS SPECIFIE~ BY ·THE DEPARTMENT; AND
(6) IT HAS ADOPTED OR WILL ADOPT AND ENFORCE A POLICY PROHIBITING THE
USE OF EXCESSIVE FORCE BY LAW ENFORCEMENT AGENCIES WITHIN ITS
JURISDICTION AGAINST ANY INDIVIDUALS ENGAGED IN NONVIOLENT CIVIL
RIGHTS DEMONSTRATIONS IN ACCORDANCE WITH SECTION 519 OF PUBLIC LAW
101-144 (NOVEMBER 9, 1989).
