A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING AND AUTHORIZING THE
CITY MANAGER TO EXECUTE A STANDARD UTILITY AGREEMENT WITH THE TEXAS
DEPARTMENT OF TRANSPORTATION FOR THE US 75 UTILITY RELOCATION
PROJECT.
WHEREAS, proposed highway improvements to US 75 by the Texas Department of
Transportation (TxDOT) necessitate the adjustment and relocation of existing water lines
owned by the City of Anna; and,
WHEREAS, the City Council of the City of Anna, Texas (the "City Council") finds that the
relocation of the water lines is in the interest of the residents of the City of Anna, Texas (the
"City"); and,
WHEREAS, TxDOT may participate in the costs for said relocation through execution of a
Standard Utility Agreement; and
WHEREAS, the City has determined that the total project cost is estimated to be
$1,883,427.55; and,
WHEREAS, the City has determined that $1,753,396.55 of the project costs are eligible for
reimbursements and that said reimbursement is expected to be 95.3% of the eligible project
cost; and,
WHEREAS, there are funds allocated to cash-flow the project through an Inter -local
agreement (ILA) with Collin County that was previously approved by the City Council and the
Collin County Commissioners Court; and,
WHEREAS, the City Council desires to authorize the City Manager to execute the Standard
Utility Agreement with TxDOT;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Recitals Incorporated.
The recitals above are incorporated herein as if set forth in full for all purposes.
Section 2. Authorization.
The City Council hereby authorizes the City Manager to execute a Standard Utility
Agreement with the Texas Department of Transportation, consistent with the agreement
attached hereto as Exhibit A. The City Manager is hereby authorized to execute all
documents and to take all other actions necessary to procure the agreement.
