A RESOLUTION OF THE CITY OF ANNA, TEXAS, (THE "CITY")
REGISTERING THE CITY'S OPPOSITION TO THE CREATION OF
COLLIN COUNTY MUNICIPAL DISTRICT NO.1, AND THE NEED FOR
A PUBLIC HEARING DELIBERATE THE MATTER.
WHEREAS, the city has been advised of the contents of the preliminary engineering report
prepared in March of 2003 for MUD No. 1, and
WHEREAS, the engineering report describes a 1,200 acre master planned community to be
known as Light Ranch, of which approximately 521 acres will be within the boundaries of the
proposed MUD No. 1, and
WHEREAS, the 521 acres are proposed to contain 443 acres of residential lots, with the
remaining 78 acres in flood plain, and
WHEREAS, the proposal is 1,318 50 X 110 foot residential lots, and 585 60 X 110 foot lots, for
a total of 1,903 residential units on the 443 acres, and
WHEREAS, the engineering report projects a population on 443 acres of over 6,600 people, and
WHEREAS, the size and density proposed for MUD No.1 creates the demand for full scope of
city services, including fire, police, ambulance, street and road installation and maintenance,
parks, building permits and inspection, and other services necessary to protect the health, safety
and welfare of the citizens purchasing residences in MUD No. 1, and
WHEREAS, the MUD district as proposed will provide only water, sewer, and storm drainage,
and
WHEREAS, the MUD district as proposed is not authorized to provide fire, police, ambulance,
parks, road maintenance, or other essential services, and
WHEREAS, the proposed tax rate of $.91 debt service and $.05 operating tax rate will not
include essential city services, except water, sewer, and storm drainage, and
WHEREAS, no city has evidenced a current intent to annex the property in MUD No. 1, and
WHEREAS, while the demands for city services in the 443 acres of MUD No.1 alone are
significant, even greater challenges are created when the additional 800 acres of mixed used of
residential, commercial and/or industrial are developed, and
WHEREAS, the burdens on schools, traffic, crime prevention and control, fire protection,
ambulance services, impact on local school districts, will, without question, fall to Collin
County, and the taxpayers of neighboring cities;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anna, Collin
County, Texas, as follows:
1. That this city, and the taxpayers within this city, will be both legally and economically
impacted by unregulated growth in a 1,200 acre development in rural Collin County, and
2. The economic impact on the City of Anna will include higher taxes to be paid to Collin
County to provide additional Sheriff's Deputies, roads and bridges, fire protection, ambulance
services, and other services which a town, but not a MUD, provides; and
3. Insufficient detail has been provided in the Petition for the creation of MUD No.1, and
the engineering report, to fully explain the additional, and significant impact that the remainder
of the 1,200 acre total project will have on this City; and
4. The City therefore does request the Texas Commission on Environmental Quality to
order a public hearing to be held regarding the petition for the creation of MUD No. l and
5. The City does, pending the outcome of the hearing, register its vigorous opposition to the
creation of Collin County MUD No. 1.
Resolved unanimously by the City Council of the City of Anna, Texas on this 8th day of July,
2003.

AFFIDAVIT OF HEIRSHIP
THE STATE OF TEXAS

KNOW ALL MEN BY THESE PRESENTS
THAT BEFORE ME, the undersigned authority, a Notary Public in and for the State of Texas
on this day personally appeared MAMIE LEE HAMMER and JACK LOCHRIDGE, hereinafter called
affiants, each of whom being first duly sworn upon oath did depose and say THAT we were well and
truly acquainted with G. H. HAMMER and wife, SALLIE LEE HA WIER, both now deceased,
during their lifetime and that the following facts are true and correct, to — wit:
THAT on November 2, A D 1944 Ray Gracy and wife Estalee (Esterlee) Gracy
conveyed to G. H. Hammer that certain lot, tract or parcel of land in the City of Aima,
Collin County, Texas more fully described in Exhibit "A" attached hereto and made a
part hereof, and
THAT G.H. Hammer was born in Clay County, Tennessee on February 25, 1886
and died intestate in Collin County ,Texas on January 14, 1958, and
Sallie Zee Harp (Hammer) was born in C1ay,County, Tennessee on May 25, 1884.
and died intestate January 8, 1964 in Collin County, Texas, and
G. H. Hammer and Sallie Lee Harp were married only one (1) time each and that
to each other, and that on November 1, 1944 they were both over twenty-one (21) years
of age and that to the union of G. H. Hammer and Sallie Lee Hammer was born the following
six (6) children and no others and none adopted, to -wit
1. CALVIN MABRY HAMN ER, a son, born in Clay County, Tennessee on
July 25, 1916 and died in Van Alstyne, Texas on November 26, 1926, being about ten (10)
years of age and without issue.
2. HOMER A. M. HAM1v1ER, a son, born in Clay County, Temiessee on February -
23, 1918 and died intestate on October 25, 1970 in Collin County, Texas and married Helen Jones on
June 7, 1944 in Collin County, Texas. Helen Jones Hammer is living and resides at 2510
Peachtree Lane, McKinney, Texas, 75070, and to the union of Homer Hammer and Helen
Jones Hammer was born the following and no others nor any adoptions, to -wit:
A. Brenda Hammer Goforth, a daughter, who resides at 632 Lockwood,
Richardson, Texas, 75080

B. .Linda Hammer Hunnicutt, a daughter, who resides at 5400 Peppertree � u.
Plano, Texas, 75074. �l
3. MARY MILDRED HAMMER, a daughter, born June 6, 1919 in Clay County,
Tennessee, married one (1) time and that to Jack Lochridge. Mildred Hammer Lochridge
had no children and she and Jack never adopted a child. Mildred died on September 17, 1992
in McKinney, Collin County, Texas leaving a will which was not probated. -7L -;1G.• '
4. HUBERT BAKER HAMMER, a son, usually referred to as
"Baker Hammer", was born in Grayson County, Texas on July 9, 1920 and died intestate on May 5,1992
in Fort Worth, Texas. Baker Hammer married first to Lurleen True in Mckinney, Texas on
March 2, 1940. To the union of Baker and Lurleen Hammer was born one (1) son only and
no adoptions. That son was born on Marct126, 1942 in Anna, Texas and was named
Hubert Baker Hammer, Jr. Shortly after the birth of Hubert Baker Hamner, Jr., his Father,
and his mother, Lurleen True Hammer were separated and never resumed any marital
relationalship. About that time Hubert Baker Hamner, Sr. joined the US Army and remained
in service about six (6) years. Also about that time Lurleen True Hammer joined the U. S. WACS
and remained in service three (3) years or more. Thereafter their child was cared for by his
maternal grandparents while his mother was in service. It is believed by these affiants (the undersigned)
that Hubert Baker Hammer, Jr. was never known by the name given him at birth. We know that
his mother later married a man who adopted the child as his own. That name and the whereabouts
of the subject child (who would be fifty nine (59) years of age if living) is unknown to the undersigned.
BAKER HAMMER married a second time to Maurice Harris and
to the union of Baker Hammer and Maurice Harris Hammer, was born the following and no
others and no adoptions, to -wit:
A. Joan Hamnner, a daughter, who now resides at 434 Fine Tree Circle, Keller, Texas, 76248.
B. Jimmy Hammer, a son, who resides at Runaway Bay, Texas.
C. Jeannie Hammer Nance, a daughter, who resides at 6156 Skylark, Watauga, Texas.
5. MAMIE LEE HAMMER, a,daughter, born in Grayson County, Texas on November 30,
1923 and is an Affiant herein.
6. MATTIE LOU HAMMER, a daughter, born in Grayson County, Texas on December 26,
1924 and died intestate in Collin County, Texas March 24, 1992 without having been married and
with� issue.
