Call to Order, Roll Call and Establishment of Quorum Mayor Pike called the meeting to order at 6:32 p.m. Council Member Martinez was absent. 2. CLOSED SESSION (EXCEPTIONS) Under Tex. Gov't Code Chapter 551, the City Council may enter into closed session to discuss any items listed or referenced on this agenda under the following exceptions: a. Consult with legal counsel regarding pending or contemplated litigation and/or on matters in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Government Code (Tex. Gov't Code §551.071); Regulations compliance review. b. Discuss or deliberate personnel matters (Tex. Gov't Code §551.074); Position of City Manager. c. Discuss or deliberate the purchase, exchange, lease, or value of real property (Tex. Gov't Code §551.072); acquisition of right-of-way, easements MOTION: Council Member Beazley moved to enter closed session. Council Member Burr seconded. Motion carried 6-0. Call to Order/Roll Call and Establishment of Quorum Mayor Pike called the meeting to order at 7:40 p.m. Council Member Martinez was absent. 2. Invocation and Pledge of Allegiance. Mayor Pike led the invocation and pledge. 3. Citizen Comments. Citizens are allowed three minutes to speak. The Council is unable to respond to or discuss any issues that are brought up during this section that are not on the agenda, other than to make statements of specific factual information in response to a citizen's inquiry or to recite existing policy in response to the inquiry. Josh Gerving, 1100 Batt Masterson Dr. - spoke in opposition to the removal of Sherley baseball field. Mayor Pike reviewed the time line of the depot relocation project. Amy Briggs, 2015 Cedar Trail - opposed to the demolition of Sherley baseball field. Danna Ward 1801 Birchwood - discussed the use of Slayter Creek fields for practice. Jim Luscombe, 1303 W. Crossing - requested a public comments time be added to the Planning and Zoning Commission agendas and more use of public media to promote awareness. Stan Carver, 2014 Rhymers Glen Dr. - spoke in favor of the relocation of the depot to Sherley park. Kristen Harkless, 11628 Wild Rose Ln. - spoke in favor of the relocation of the depot to Sherley park. Gary Hughes, Anna Historical Society - spoke in favor of the relocation of the depot to Sherley park and extended an invitation to all for the First Annual Collin -McKinney Day luncheon on March 3, 2018. Andy Michrina, 902 Fulboume Dr. - read a customer focus statement. Lori Harris, 2123 Luscombe Ln. - opposed to the removal of Sherley baseball field. Marietta Schell, 2115 Taylor Blvd. - showed photographs she had taken of Shertey baseball field and downtown Anna. 4. Receive reports from Staff or the City Council about items of community interest. Items of community interest include: expressions of thanks, congratulations, or condolence, information regarding holiday schedules; an honorary or salutary recognition of a public official, public employee, or other citizen (but not including a change in status of a person's public office or public employment); a reminder about an upcoming event organized or sponsored by the goveming body, information regarding a social, ceremonial, or community event organized or sponsored by an entity other than the goveming body that was attended or is scheduled to be attended by a member of the goveming body or an official or employee of the municipality, and announcements involving an imminent threat to the public health and safety of people in the municipality that has arisen after the posting of the agenda. a. Recognize members of the Charter Review Commission Mayor Pike recognized and presented the members of the Charter Review Commission with certificates of appreciation for their service to the City. Interim Police Chief Caponera recognized and thanked Paul Lindsey with Big Brother Pest Control for forming a Back the Blue program and donating $600 to the department. 5. Consent Items. These items consist of non -controversial or "housekeeping" items required by law. Items may be considered individually by any Council member making such request prior to a motion and vote on the Consent Items. Consent Items d. and e. were removed. a. Approve the City Council Meeting Minutes: December 9, 2017 December 12, 2017 b. Review minutes of the EDC meeting from September 7, 2017 and October 5, MmM2017-01-09 Reg 2017. (Jessica Perkins) c. Review minutes from the CDC meeting from September 7, 2017 and October 5, 2017. (Jessica Perkins) MOTION: Council Member Burr moved to approve Consent Items a, b, and c. Council Member Bryan seconded. Motion carried 6-0 d. Authorize the City Manager to solicit bids for the Natural Springs Park Driveway and Parking Lot. (Maurice Schwanke) The Natural Springs Park Driveway and Parking Lot Project consists of approximately 350 linear feet of 24 foot driveway and 28 parking spaces. The driveway will line up with the new median opening and driveway approach that has been constructed as part of the F.M. 455 TXDOT project. The drive and parking will provide permanent access to Natural Springs Park and to the recently completed park office/public restroom facilities/park equipment storage and maintenance building. The project was designed by Birkhoff, Hendricks & Carter, L.L.P. The plans and design were funded by the Anna Community Development Corporation. The construction of this project is expected to cost approximately $170,000. Funds are available for this project through the Park Trust Fund approved 2018 Budget. MOTION: Council Member Miller moved to approve. Council Member Burr seconded. Motion carried 6-0 e. Consider/Discuss/Act on Resolution approving "Lot 2 Block A of AutoZone Addition" Re -Plat. The "Lot 2 Block A of AutoZone Addition" re -plat contains 5.225 acres located in the Joseph Schluter survey, abstract 856. The re -plat will be subdividing Lot 2 Block A of Autozone Addition into four separate lots. Lot 2R-1 will be the location of a proposed two story indoor mini -storage facility encompassing approximately 64,260 square feet. This project would replace existing "Windmill Storage" facility. Lot 2R- 2 is to be traded to the City as part of a land -swap agreement involving lots 2R-3 and 2R-4. Lot 2R-2 will be incorporated by the City into Natural Springs Park. This is in exchange with Lots 2R-3 and Lots 2R-4. Lot 2R-3 will remain open space while Lot 2R-4 will be the site of a new daycare facility. This daycare facility will be one story with the capacity for 195 students. The City has received a no drainage impact letter on the project. Additionally, the land -swap agreement was approved by the voters of Anna. A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING A RE -PLAT OF LOT 2 BLOCK AAUTOZONE ADDITION. MOTION: Council Member Beazley moved to approve. Council Member Bryan seconded. Motion carried 5-1. Miller opposed. 6. Consider/Discuss/Act on a Resolution receiving the final report of the CCmin2017-01-09 Reg Charter Review Commission and ordering publication of Said Report (Connie Stump) Chairperson Connie Stump reviewed the final report prepared by the Charter Review Commission. The Commission recommends that the amendments be set forth in three separate ballot measures regarding the following topics: (1) alternative method of publication; (2) amended method of adoption of personnel regulations; and (3) increasing and extending penalties for certain Charter violations including nepotism. A RESOLUTION OF THE CITY OF ANNA, TEXAS RECEIVING THE FINAL REPORT OF THE CHARTER REVIEW COMMISSION AND ORDERING PUBLICATION OF SAID REPORT MOTION: Council Member Burr moved to approve. Council Member Beazley seconded. Motion carried 6-0. 7. Resolution appointing Interim City Manager. (City Council) The City Council entered into an agreement with Texas First Group("Temporary Services Agreement') to provide an individual to fill the role of I nterim City Manager. Mr. Bill J. Shipp Jr. was interviewed by a sub committee of the City Council. Mr. Shipp is being recommended to fill the position of Interim City Manager while the Council seeks a permanent person for the post. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANNA APPOINTING AN INTERIM CITY MANAGER AND ESTABLISHING AN EFFECTIVE DATE MOTION: Council Member Bryan moved to approve subject to the start date of January 16, 2018. Council Member Beazley seconded. Motion carried 6-0 8. Consider/Discuss/Act on a Resolution appointing a member to the Greater Texoma Utility Association Board of Directors. (City Council) Mr. David Stump appointed to the Board of Director's has stepped down from the GTUA Board of Directors and the Council will need to fill the vacancy created. The term will be for one-year expiring in December 2018. The qualifications for the position are as follows: (1) the person may not be a Director if he or she is an officer, employee, or member of the governing body of a municipal corporation, and (2) each Director shall be a qualified Elector of the city that nominates him or her. MOTION: Mayor Pike moved to table this item to a future meeting. Council Member Bryan seconded. Motion carried 6-0. 9. Consider/Discuss/Act on a recommendation to Appoint a Representative to the North Texas Groundwater Conservation District Board. (Maurice Schwanke) CCmin2017-01-09 Reg Philip Sanders has submitted his resignation to the Board of Directors to the North Texas Groundwater Conservation District. As such, an appointment is necessary to fill the vacancy to serve the remaining term for the position through June 1, 2019. Since Anna is the largest groundwater producer in the region it is important that we are well represented on this Board. Once a nomination is made we will need to provide the nomination to the Collin County Commissioners Court for selection. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, RECOMMENDING AN APPOINTMENT TO THE NORTH TEXAS GROUNDWATER CONSERVATION DISTRICT BOARD OF DIRECTORS MOTION: Mayor Pike moved to approve and appoint Maurice Schwanke. Council Member Miller seconded. Motion carried 6-0 10. Discuss/Consider creating a Neighborhood Design Standards Committee. (Maurice Schwanke) The Resolution before the Council would establish a committee and the makeup and structure of the Committee. At a subsequent meeting members of the Council would be asked to appoint members to the Committee. The Committee shall perform its duties solely in an advisory capacity, advising the Planning and Development Department of the City in regard to preparing a Neighborhood Design Manual. Council discussed increasing the number of committee members to 12. This item will be brought back to Council at a future meeting. 11. CLOSED SESSION (EXCEPTIONS) Under Tex. I am a husband, father of 5 and a 12 year resident of the city of Anna. I come before you this evening to speak on the Historical Society's Train Depot project and the land that it is proposed to be built on - Sherley Field. I believe that the Train Depot project should be reconsidered and replanned to accommodate both the Depot and the baseball field. While I am only one person, I believe I am speaking on behalf of over a hundred other citizens in Anna and most likely more, including the children that those citizens have who play baseball locally and abroad. There are polls and petitions accessible on social media to back this claim. 1. We believe Slater Creek is not enough to make up for the absence of Sherley. Even with the high school having their own fields, Slater is not enough. Last spring multiple teams used Slater and Sherley at multiple times several days a week for league practices. I recently created a Sandlot Group where kids can play organized games with no umpires or parents involved. Local kids have played 3 games at Sherley and have asked for more. To say Sherley Field is under utilized is just flat wrong. We use it weekly. I have even called other coaches to ask if they might be using it to prevent a conflict. 2. We believe the Ball Field has just as much Historical value as the Depot. 3. We believe that a Depot/Ballpark combination could be a compromise that would satisfy both parties on this issue. Not only would it satisfy both parties, it could become a venue that attracts business to downtown Anna. Imagine standing at the northwest corner of Sherley and 4th looking southeast toward the field. You see the Depot where the snackbar is... From the outside it is a Train Depot. From the inside it is a snackbar. You see a rail car near third base. On the inside it is the third base dugout. You see the same at first base. From the fence in Centerfield to the left field foul pole you see rail cars in tow, or maybe you see one car and a platform where spectators could sit and watch games. You see a specially designed scoreboard that reflects the History of the Depot. Soon after completion this venue attracts tournaments. Teams come from all over DFW to play at this one -of -a -kind facility. Llines at the restaurants down the street are out the door. Had this project been a measure to be voted on, I have no doubt the citizens of Anna would have voted to keep the baseball field in use. It has come to my knowledge that the former commissioner of baseball approached the Historical Society last year and offered plans for a Depot/Ballfield combo. He was turned away. Other coaches have offered their own time and money to enhance Sherley Field and were also turned away by city officials. If this Depot was the future of Sherley, why weren't these coaches informed when they made their offers? Lastly, and going forward, if a compromise cannot be achieved, I ask the city of Anna to hear the voice, TO HEAR THE VOICE of many citizens who feel they have been robbed of 0-, valuable baseball field. City Council and Mayor, I'd like to read you a passage from the history book A Town Named Anna. The most important event that was to result in the building of a new town to be named Anna occurred in 1872, That was the year when the Houston and Texas Cen- tral Railroad (later to become the Southern Pacific) ran a line from Dallas to Denison through McKinney and Sherman. The line established a stop that for more than ten years was nothing more because there wee*e no buildings there. But in 1883 the railroad stop became a town when some twenty people moved there. A post office was established that same year, and the new town was given the name Anna. While I had hoped that we turned out at least one Major League Baseball player, the MLB roosters don't show anyone claiming Anna as their place of origin. Perhaps it's because we've not given our offspring a regulation -sized field like Sherley Park. Many are gathered tonight to complain about the goings-on at Sherley Park, but the reality is that this project has been quite public and openly -discussed. Recognize that those that have chosen to protest now, are doing so out of apathy to be involved with our Parks Advisory Board or our Community Action Planning Committee. Both are open to the public. Both have received invites from me personally to attend. To date, only five citizens have attended the parks advisory board meetings in the years I've been appointed --none of who are protesting now. The Parks Advisory Board officially visited Sherley Park twice -both times agreed Sherley Park is better -suited for the train depot and supports the establishment of Anna's historic district. As Chairman of the Parks Advisory Board, I have made multiple trips to Sherley Park. I've even knocked a few baseballs there myself. While the nostalgia in me likes the baseball field amidst the historic water tower and the Christian Church, the field is undersized, dilapidated, and ultimately unsafe. One fly ball into the ever-increasing traffic of 2862 will eventually result in an accident when someone attempts to fetch that ball. I must note that the vast majority of times I've observed this ballpark, it has been void of anyone. Bottom-line is the train depot represents the origin of the City of Anna. Its original location is a few feet from Sherley Park. We are now bringing it back home and building a beautiful park to commemorate the birthplace of Anna. As for the children, the Youth Sport's Association agrees that the fields at Slayter Creek Park are much better for their practices, games, and gives the capability of holding tournaments. The fields are well-maintained. However, anyone wanting to play sandlot baseball, there are two established baseball fields at Johnson Park, only a couple of city blocks north of Sherley Park where all can play in safety. Council, a citizen has drawn negative light on the diligent decision making that occurs in this very room by people who give up their time to do what is best for Anna, now and in the future. If you cave to the pressure a few uninvolved citizens, you undermine the integrity of every decision made in this room including your own. Comments: FAi;r,)0T OF srfkcN 1. i City Council and Mayor, I'd like to read you a passage from the history book A Town Named Anna. The most important event that was to result in the building of a new town to be named Anna occurred in 1872. That was the year when the Houston and Texas Cen- tral Railroad (later to become the Southern Pacific) ran a line from Dallas to Denison through McKinney and Sherman. The line established a stop that for more than ten years was nothing more because there were no buildings there. But in 1883 the railroad stop became a town when some twenty people moved there. A post office was established that same year, and the new town was given the name Anna. While I had hoped that we turned out at least one Major League Baseball player, the MLB roosters don't show anyone claiming Anna as their place of origin. Perhaps it's because we've not given our offspring a regulation -sized field like Sherley Park. Many are gathered tonight to complain about the goings-on at Sherley Park, but the reality is that this project has been quite public and openly -discussed. Recognize that those that have chosen to protest now, are doing so out of apathy to be involved with our Parks Advisory Board or our Community Action Planning Committee. Both are open to the public. Both have received invites from me personally to attend. To date, only five citizens have attended the parks advisory board meetings in the years I've been appointed --none of who are protesting now. The Parks Advisory Board officially visited Sherley Park twice -both times agreed Sherley Park is better -suited for the train depot and supports the establishment of Anna's historic district. As Chairman of the Parks Advisory Board, I have made multiple trips to Sherley Park. I've even knocked a few baseballs there myself. While the nostalgia in me likes the baseball field amidst the historic water tower and the Christian Church, the field is undersized, dilapidated, and ultimately unsafe. One fly ball into the ever-increasing traffic of 2862 will eventually result in an accident when someone attempts to fetch that ball. I must note that the vast majority of times I've observed this ballpark, it has been void of anyone. Bottom-line is the train depot represents the origin of the City of Anna. Its original location is a few feet from Sherley Park. We are now bringing it back home and building a beautiful park to commemorate the birthplace of Anna. As for the children, the Youth Sport's Association agrees that the fields at Slayter Creek Park are much better for their practices, games, and gives the capability of holding tournaments. The fields are well-maintained. However, anyone wanting to play sandlot baseball, there are two established baseball fields at Johnson Park, only a couple of city blocks north of Sherley Park where all can play in safety. Council, a citizen has drawn negative light on the diligent decision making that occurs in this very room by people who give up their time to do what is best for Anna, now and in the future. If you cave to the pressure a few uninvolved citizens, you undermine the integrity of every decision made in this room including your own.
