HomeMy WebLinkAboutRes 2018-04-424 Land Exchange for part of Natural Springs ParkCITY OF ANNA, TEXAS RESOLUTION NO. iA) ' - 4 A RESOLUTION OF THE CITY OF ANNA, TEXAS, APPROVING A LAND EXCHANGE AUTHORIZED BY VOTERS OF THE CITY OF ANNA IN A MAY 6, 2017 ELECTION FOR PROPERTY TO BECOME PART OF NATURAL SPRINGS PARK IN EXCHANGE FOR LAND CURRENTLY PART OF NATURAL SPRINGS PARK WHEREAS, on May 6, 2017, the voters of the City of Anna, Texas (the "City") voted in a duly held election in favor of a proposition to authorize the City to acquire a certain 1.185 -acre tract to be used for park purposes, said property being described in Exhibit A and depicted in Exhibit B (the "New Park Land") in exchange for granting title to a certain 1.185 -acre tract of City -owned park property, said property also being depicted in Exhibit B and separately described in Exhibit C (the "City Tract"); and WHEREAS, the City Council of the City of Anna, Texas ("City Council'), has found thal the New Park Land is more suitable than the City Tract for use as park land, to be part of the City -owned park known as Natural Springs Park; and, WHEREAS, AKMR Anna Storage LLC, owner of the New Park Land ("Owner") has agreed to convey said property to the City in exchange for the City conveying the City Tract to an affiliate of Owner, AKMR Anna Daycare LLC ("Daycare"); and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS, THAT: Section 1. Recitals Incorporated. The recitals above are incorporated herein as if set forth in full for all purposes. Section 2. Publication of Food Service Establishment Health Scores. The City Council hereby approves the conveyance and granting of fee simple title to the City Tract to Daycare or one or more of Daycare's affiliates by special warranty deed in exchange for the conveyance and granting to the City by the Owner or one or more of Owner's affiliates of fee simple title to the New Park Land by special warranty deed and the City Council further hereby authorizes, approves, and ratifies the City's duly authorized agents, including the Mayor or City Manager, to execute or to have executed all required instruments to accomplish the land exchange identified in this resolution.
