RESOLUTION NO. iA) ' - 4
A RESOLUTION OF THE CITY OF ANNA, TEXAS, APPROVING A LAND
EXCHANGE AUTHORIZED BY VOTERS OF THE CITY OF ANNA IN A MAY 6, 2017
ELECTION FOR PROPERTY TO BECOME PART OF NATURAL SPRINGS PARK IN
EXCHANGE FOR LAND CURRENTLY PART OF NATURAL SPRINGS PARK
WHEREAS, on May 6, 2017, the voters of the City of Anna, Texas (the "City") voted in
a duly held election in favor of a proposition to authorize the City to acquire a certain
1.185 -acre tract to be used for park purposes, said property being described in Exhibit
A and depicted in Exhibit B (the "New Park Land") in exchange for granting title to a
certain 1.185 -acre tract of City -owned park property, said property also being depicted
in Exhibit B and separately described in Exhibit C (the "City Tract"); and
WHEREAS, the City Council of the City of Anna, Texas ("City Council'), has found thal
the New Park Land is more suitable than the City Tract for use as park land, to be part
of the City -owned park known as Natural Springs Park; and,
WHEREAS, AKMR Anna Storage LLC, owner of the New Park Land ("Owner") has
agreed to convey said property to the City in exchange for the City conveying the City
Tract to an affiliate of Owner, AKMR Anna Daycare LLC ("Daycare"); and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ANNA, TEXAS, THAT:
Section 1. Recitals Incorporated.
The recitals above are incorporated herein as if set forth in full for all purposes.
Section 2. Publication of Food Service Establishment Health Scores.
The City Council hereby approves the conveyance and granting of fee simple title to the
City Tract to Daycare or one or more of Daycare's affiliates by special warranty deed in
exchange for the conveyance and granting to the City by the Owner or one or more of
Owner's affiliates of fee simple title to the New Park Land by special warranty deed and
the City Council further hereby authorizes, approves, and ratifies the City's duly
authorized agents, including the Mayor or City Manager, to execute or to have executed
all required instruments to accomplish the land exchange identified in this resolution.

Metes and Bounds Description of the New Park Land
Being a part of Lot 2, Block A, of Autozone Addition, an Addition to the City of Anna,
Collin County, Texas, according to the plat thereof recorded in Volume 2007, Page 221,
Official Public Records, Collin County, Texas, and being part of the same tract of land
described in deed to Windmill Self Storage, LP., recorded in Instrument No.
20100920000999400, Official Public Records, Collin County, Texas, and being more
particularly described as follows:
Commencing at a 1/2" iron rod found in the South line of W. White Street, a variable
width right-of-way, at the Northwest corner of Lot 1, of said Block A, of said Autozone
Addition, same being the Northeast corner of Lot 4, Block A, of Anna Market Center, an
Addition to the City of Anna, Collin County, Texas, according to the plat thereof
recorded in Volume 2008, Page 361, Official Public Records, Collin County, Texas;
Thence South 02°21'13" West, passing at a distance of 173.81' to a 5/8" iron rod found
at the common Easterly corner of said Lots 1 and 2, Block A, of said Autozone Addition,
continuing a total distance of 554.81' to a 1/2" iron rod with a yellow plastic cap stamped
"RPLS 5310" set for corner in the East line of Lot 9, Block A, of said Anna Market
Center, and being the PLACE OF BEGINNING of the tract of land described herein;
Thence South 87048'51" East, a distance of 266.68' to a 1/2" iron rod with a yellow
plastic cap stamped "RPLS 5310" set for corner in the West line of a tract of land
described in deed to the City of Anna, recorded in Instrument No.
200607140000982730, Official Public Records, Collin County, Texas;
Thence South 02°40'00" West, along said West line, a distance of 195.00' to a 1/2" iron
rod with a yellow plastic cap stamped "RPLS 5310" set at the Northeast corner of a tract
of land described in deed to the City of Anna, recorded in Instrument No.
2009033000036590, Official Public Records, Collin County, Texas;
Thence North 87020'00" West, a distance of 265.62' to a 1/2" iron rod with a yellow
plastic cap stamped "RPLS 5310" set for corner in the said East line of said Lot 9, Block
A;
Thence North 02°21'13" East, along said East line, a distance of 192.77' to the PLACE
OF BEGINNING and containing 51,602 square feet or 1.185 acres of land.

according to the plat thereof recorded in Volume 2007, Page 221, Official Public
Records, Collin County, Texas, and being part of tracts of land described in deeds to
Anna Community Development Corporation, recorded in Instrument No.
2009033000036590, Official Public Records, Collin County, Texas, and being more
particularly described as follows:
Beginning at a 1/2" iron rod with a yellow plastic cap stamped "RPLS 5310" set in the
South line of W. White Street, a variable width right-of-way, at the Northwest corner of a
tract of land described in deed to City of Anna, recorded in Instrument No.
