QJ 2 - W�­ 4q (May 5, 2018 Election Canvass) A RESOLUTION OF THE CITY OF ANNA, TEXAS CANVASSING THE RETURNS OF A GENERAL ELECTION OF TWO CITY COUNCIL MEMBERS, ALL FOR THREE- YEAR TERMS EXPIRING MAY 2020, AND A SPECIAL ELECTION INCLUDING PROPOSITIONS A-E FOR AMENDMENTS TO THE CITYS HOME RULE CHARTER. WHEREAS, a general election was held in the City of Anna, Texas on May 5, 2018 for the purpose of electing two city council members, all for three-year terms; and WHEREAS, a special election was held in the City of Anna, Texas on May 5, 2018 for the purpose of the voters deciding on proposed amendments to the City's Home Rule Charter as set forth in Proposition A, Proposition B, Proposition C, Proposition D, and Proposition E; and WHEREAS, the City Council of the City of Anna ("Council") has reviewed and investigated all matters pertaining to this election and returns thereof; and WHEREAS, the Council hereby canvasses the returns of this election, at which there was submitted to all resident, qualified electors of the City for their action thereupon, the election of two city council members, all for three-year terms, and the above -referenced propositions to amend the City's Home Rule Charter; and WHEREAS, the Council has diligently inquired into the poll lists and the official election returns which were duly and lawfully made to this Council by the judges, officials and clerks holding and conducting the election, the poll lists and the official elections returns showing separately the votes cast in the election; and WHEREAS, from the returns, this Council hereby finds that the following votes were cast in the election by voters who were resident, qualified electors of the City; and WHEREAS, each of the candidates in said election received the following votes: Candidate/or Proposition Mayor (Alcalde) Nate Pike City Council, Place 1 (Concilio de Ciudad, Lugar 1) Stan Carver 11 Kevin Matthew Toten Resolution 'Al �--m - WQ Canvassing the May 5, 2018 Election Number of Votes 363 114 100 Justin Burr 79 Anthony D. Richardson 73 Bill Morgan 33 John Houcek 14 WHEREAS, the propositions for amendments to the City's home rule charter in said election received the following votes; Anna Proposition A Allow personnel regulations to be adopted by resolution of the City Council. For 238 Against 165 Anna Proposition B Allow the City Council to fill by appointment any vacancy occurring on the City Council for an unexpired term of 12 months or less. For 273 Against 148 Anna Proposition C Add prohibition against nepotism to the penalties established under City of Anna Home Rule Charter Section 14.06, thereby causing a violation of the nepotism rules to result in forfeiture of an elected or appointed City position and a period of ineligibility for same. For 333 Against 79 Anna Proposition D Increase the period of ineligibility to hold an elected or appointed City position from five years to ten years for violation of any penalty listed under City of Anna Home Rule Charter Section 14.06. For 290 Against 128 Anna Proposition E Allow publication of City ordinances, resolutions, notice of public budget hearing, audit summary, and various other notices and materials required to be published under the City of Anna Home Rule Charter or other law by means other than newspaper publication, to the extent permissible under state law. For Against 353 56 Resolution Canvassing the May 5, 2018 Election THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ANNA THAT: SECTION 1. The Council officially finds, determines, and declares that the election was dully and properly ordered, that proper legal notice of such election was duly given in the English language and the Spanish language, that proper election officers were duly appointed prior to the election, that the election was duly and legally held, that all resident, qualified electors of the City were permitted to vote at the election, and due returns of the results of the election had been made and delivered, and that the City of Anna has duly canvassed such returns, all in accordance with the laws of the State of Texas and of the United States of America and the Ordinance calling the election. SECTION 2. The following person is therefore elected as Mayor of the City for a term of three (3) years: Mayor Nate Pike SECTION 3. It is hereby certified that no candidate for City Council, Place 1 received a majority of votes cast in the May 5, 2018 election and a runoff election will be required between the candidates with the highest and second highest number of votes in accordance with the City of Anna Home Rule Charter and Texas law. SECTION 4. The following propositions were therefore adopted for the City: Proposition A Allow personnel regulations to be adopted by resolution of the City Council. Smith, City Secretary Resolution Canvassing the May 5, 2018 Election 4 STATE OF TEXAS CANVASS OF THE CITY OF ANNA ELECTION COUNTY OF COLLIN § MAY 5, 2018 1, Bruce Sherbet, the undersigned Elections Administrator of Collin County, do hereby certify that I have made an actual check and comparison of all the ballots tabulated as voted with the Return Sheets, and the unused ballots as recorded on the Register of Official Ballots. 1, therefore, make the following report of my findings from the May 5, 2018, City of Anna Election that was held in Collin County, Texas.
