Call to Order, Roll Call and Establishment of Quorum Mayor Pike called the meeting to order at 6:31 p.m. Council Member's Bryan and Reeves were absent. Chairperson Finan called the meeting to order at 6:33 p.m. Board Member's Barrett and Hansen were absent. 2. JOINT MEETING Presentation and Discussion with the Parks Advisory Board. 3. CLOSED SESSION (EXCEPTIONS) Under Tex. Gov't Code Chapter 551, the City Council may enter into closed session to discuss any items listed or referenced on this agenda under the following exceptions: a. Consult with legal counsel regarding pending or contemplated litigation and/or on matters in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Chapter 551 of the Government Code (Tex. Gov't Code §551.071). Consultant Contract, Meeting Procedures b. Discuss or deliberate the purchase, exchange, lease, or value of real property (Tex. Gov't Code §551.072); city facilities; acquisition of easements c. Discuss or deliberate Economic Development Negotiations: (1) To discuss or deliberate regarding commercial or financial information that the City has received from a business prospect that the City seeks to have locate, stay, or expand in or near the territory of the City of Anna and with which the City is conducting economic development negotiations; or (2) To deliberate the offer of a financial or other incentive to a business prospect described by subdivision (1). Call to Order/Roll Call and Establishment of Quorum Mayor Pike called the meeting to order at 7:10 p.m. Council Member's Bryan and Reeves were absent. 2. Invocation and Pledge of Allegiance. Mayor Pike led the invocation and pledge. 3. Citizen Comments. Citizens are allowed three minutes to speak. The Council is unable to respond to or discuss any issues that are brought up during this section that are not on the agenda, other than to make statements of specific factual information in response to a citizen's inquiry or to recite existing policy in response to the Inquiry. Elizabeth Hickey, 623 Haven - Concerns with the quality of homes being built in the City. Kelly Patterson - Herndon, 239 Belford St. South - opposes agenda item 13. She stated the City needs more businesses and less homes. William Morgan, 2029 Helmoken Falls Dr - has concerns with the new Municipal Complex. 4. Receive reports from Staff or the City Council about items of community interest. Items of community interest include: expressions of thanks, congratulations, or condolence; information regarding holiday schedules; an honorary or salutary recognition of a public official, public employee, or other citizen (but not including a change in status of a person's public office or public employment); a reminder about an upcoming event organized or sponsored by the governing body; information regarding a social, ceremonial, or community event organized or sponsored by an entity other than the goveming body that was attended or is scheduled to be attended by a member of the governing body or an official or employee of the municipality, and announcements involving an imminent threat to the public health and safety of people in the municipality that has arisen after the posting of the agenda. a. Introduction and Demonstration of K-9. (Jeff Caponera) Police Chief Caponera introduced K-9 officer Ninja and officer Cory Goodman. 5. Consent Items. These items consist of non -controversial or "housekeeping" items required by law. Items may be considered individually by any Council member making such request prior to a motion and vote on the Consent Items. a. Approve Council Meeting minutes from February 26, 2019. (Carrie Smith) b. Review the February 4, 2019 Planning and Zoning meeting minutes. (Maurice Schwanke) c. Review the Park Board Minutes for October 29, 2018 and January 28, 2019. (Maurice Schwanke) d. Approve a Resolution approving the Bridges Addition Development Plat. (Maurice Schwanke) The development plat is located within Anna's extra territorial jurisdiction and is located off of the Southwestern side of County Road 477 and FM 2862. The tract is in the James Fisher Survey, Abstract No. 305 and contains 2.0 acres of land. The owner is proposing to put a new home, garage, and shop. The submittal meets the City of Anna development plat requirements. A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING THE BRIDGES ADDITION DEVELOPMENT PLAT e. Approve a Resolution approving the Camden Parc Phase 4 Final Plat. (Maurice Schwanke) Camden Parc Phase 4 is located in the J.C. Brantley Survey, Abstract No. 114. The plat contains approximately 47.99 acres covering a section of land East of Highway 5 and to the South of Phase 1 and 2 of Camden Parc that will consist of 165 lots. A RESOLUTION OF THE CITY OF ANNA, TEXAS APPROVING A FINAL PLAT OF CAMDEN PARC PHASE 4. f. Approve a Resolution approving a special event application by Kevin Hall, Executive Director and representative for the Greater Anna Chamber of Commerce, to sponsor an "Easter Egg Hunt" event to be held on Saturday, April 20, 2019 at Slayter Creek Park. (Maurice Schwanke) MOTION: Council Member Miller moved to approve the consent agenda. Council Member Beazley seconded. Motion carried 5-0. Briefing/Presentation/Discussion regarding the design and budget for the proposed Municipal Complex. (Jim Proce) No action, presentation by Randall Scott. 7. Consider/Discuss/Action regarding a Resolution authorizing the City Manager to execute an Additional Services Proposal with Randall Scott Architects for additional professional architectural services for revisions to the fire station portion of the Municipal Complex Project. (Joseph Johnson) At the request of the City, Randall Scott Architects (RSA) has provided an Additional Services Proposal for architectural services to design a revision to the plans for the proposed fire station. The revision would add a half bay to the Apparatus Room and includes modifications to first floor and mezzanine floor plans, site plans, building elevations, building sections, and interior elevations. Additionally, detail sheets for architectural, mechanical -electrical & plumbing (MEP), structural, civil, and information technology (IT) will be revised. RSA estimates that the revisions will increase the construction cost by approximately $750,000 and proposes to make the plan revisions for a lump sum fee of $58,750. Funds are available for the plan revision in the Combination Tax and Revenue Certificates of Obligation Series 2018, said funds being assigned for this purpose. MOTION: Council Member Miller moved to approve. Council Member Toten seconded. Motion carried 5-0. 8. a. Conduct public hearing on creation of Tax Increment Reinvestment Zone Number 2, City of Anna, Texas. b. Consider/Discuss/Action on an ordinance of the City Council of the City of Anna, Texas, designating a contiguous geographic area within the City as a tax increment reinvestment zone pursuant to Chapter 311 of the Texas Tax Code, to be known as Tax Increment Reinvestment Zone Number Two, City of Anna; describing the boundaries of the Zone; creating a board of directors for the Zone; establishing a tax increment fund for the Zone; containing findings related to the creation of the Zone; providing a date for the termination of the Zone; providing that the Zone take effect immediately upon passage of the Ordinance; providing a severability clause; and providing an effective date. Consider/Discuss/Action on an Ordinance of the City Council of the City of Anna, Texas accepting and approving a Service And Assessment Plan and assessment rolls for the Hurricane Creek Public Improvement District; making a finding of special benefit to the property in the District; levying special assessments against property within the District and establishing a lien on such property; providing for the method of assessment and the payment of the assessments in accordance with chapter 372, Texas Local: Government Code, as amended, providing penalties and interest on delinquent assessments, providing for severability, and providing an effective date. Council Member Miller seconded. Motion carried 5-0. 12. a. Public Hearing: For City Council to hear public comment regarding the creation of the Sherley Tract Public Improvement District. b. Consider/Discuss/Action regarding a resolution approving the creation of the Sherley Tract Public Improvement District. (City Council) Mayor Pike opened the public hearing at 8:35 p.m. Robert Miklos spoke about the project. MOTION: Mayor Pike moved to hold the public hearing open until the May 14th Council agenda. Council Member Beazley seconded. Motion carried 5-0. 13. a . Conduct a public hearing to consider public comments regarding a request by Don Collins, the representative for Kyle and Wendy Rollins, the owners of the property. The property is currently zoned Agriculture (AG). The applicant requests to replace the existing zoning to a proposed Planned Development for Multi -Family. The property is located at 1220 S Powell Pkwy and is generally located West of S Powell Pkwy and South of W White St. b. Consider/Discuss/Action on a recommendation regarding the request by the applicant and owners of the property to replace the existing zoning with a new Planned Development zoning. (Maurice Schwanke) The proposed zoning request for multi -family is generally in compliance with the "Proposed Comprehensive Plan and the existing "Comprehensive Plan" for Anna. The variation is that the Plans show commercial uses adjacent to Powell Parkway instead of Multifamily. A significant part of this property is covered by flood plain. Two stock ponds also occupy part of this property as well as Slayter Creek forming the west property line. From a land use standpoint this property is buffered from single family development by the Slayter Creek buffer on the west (heavily treed), existing multi -family property on the south, open commercial property on the north and east. Powell Parkway forms part of the eastern boundary. The standards proposed closely resemble other recently approved multi -family zonings to the south and the "Palladium" Development. No concept plan accompanies this planned development; however, one is required with elevations prior to civil plan submittals. Mayor Pike opened the public hearing at 8:40 p.m. Developer Don Collins discussed the project and requested Council's approval. Bill Morgan - He is concerned that a planned development will hurt the city and residents. Marietta Schell - opposes approving the project because Council does not have all the information required. She also is concerned about the impact on traffic in the area. Christine Lewis - opposed John - concerned with smaller lot sizes and drainage. Mayor Pike closed the public hearing at 9:26 p.m. MOTION: Mayor Pike moved to hold the public hearing open to a future date. Council Member Beazley seconded. Motion failed 3-2 Toten, Tutson, Miller opposed. MOTION: Council Member Miller moved to deny. Council Member Tutson seconded. Motion carried 4-1. Beazley opposed. 14. Consider/Discuss/Action regarding a Resolution authorizing the City Manager to execute an Interlocal Agreement with Collin County for radio equipment proposed to be placed on the Hackberry Elevated Storage Tank. (Joseph Johnson) In 2018, Collin County submitted plans and specifications to the City of Anna related to a proposal by Collin County to install radio equipment at the Hackberry Elevated Storage Tank (EST) site. The project is necessary for the County's multi- million dollar upgrade to its public safety radio communication system. The Hackberry EST is the proper height and location for radio equipment based upon a study completed by the County's consultant with regard to proper triangulation and coverage. The plans and specifications have been reviewed by City staff and the City's consulting engineer and have been approved pending execution of an Interlocal Agreement. Under the Interlocal Cooperation Act, Texas Government Code, Chapter 791, the City and Collin County may enter such an agreement. The Interlocal Agreement provides the terms under which the City of Anna and Collin County may cooperate on the project. Key factors in the agreement are: 1) The term is until September 30, 2036, but the City may request that the County equipment be removed with one year notice provided that the City needs the space for its own radio equipment. 2) If the City discontinues use of the County's radio system, the County will pay the City an annual fee not to exceed $20,000. 3) The City benefits from use of the County radio system and the improved coverage due to the proximity of the radio equipment. 4) The City is allowed to connect the electrical equipment and instrumentation within the water tower to the County's standby power generator. 5) The agreement establishes that the principal use of the tower is as a water tower for water system use. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS AUTHORIZING THE CITY MANAGER TO EXECUTE AND ADMINISTRATE AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF ANNA AND COLLIN COUNTY IN WHICH THE CITY OF ANNA AND COLLIN COUNTY AGREE TO TERMS FOR THE PLACEMENT OF COLLIN COUNTY RADIO EQUIPMENT ON PROPERTY AND INFRASTRUCTURE OWNED BY THE CITY OF ANNA MOTION: Council Member Beazley moved to approve. Council Member Toten seconded. Motion carried 5-0. 15. Consider/Discuss/Action on a Resolution approving an Incentive Agreement for Economic Development Between the City of Anna and Zablink Hospitality. (Joey Grisham) Zablink Hospitality owns 2.002 acres in Anna Town Center. They are building Anna's first hotel, a Holiday Inn Express, that will have 93 rooms. The hotel is a $6.4 Million capital investment, projected to make $2,000,000 in revenue after its first full year of operation and create 26 jobs. The amount of property tax that will be created for Anna is projected to be approximately $37,000 a year, and the amount of hotel/motel occupancy tax is projected to be $140,000 a year. Zablink Hospitality has requested a deferment of a portion of the roadway impact fees. They estimated their development fees to be $60,000. The combined development fees ended up $194,000. This agreement would allow Zablink Hospitality to pay $80,000 up front in development fees and defer $114,642 for two years after the effective date. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANNA, TEXAS APPROVING A PROJECT LOCATED AT ANNA TOWN CENTER HOTEL — LOT 3, F.T. DAFFAU SURVEY, A-288 THOMAS RATTON SURVEY, A-782, CITY OF ANNA, COLLIN COUNTY, TEXAS AND RELATED INCENTIVE AGREEMENT FOR NEW ECONOMIC DEVELOPMENT WITH ZABLINK HOSPITALITY, LLC AND THE CITY OF ANNA, COLLIN COUNTY, TEXAS AND AUTHORIZING THE DEFERMENT OF THE TIME AT WHICH A CERTAIN PORTION OF ROADWAY IMPACT FEES ASSESSED ON THE PROJECT SHALL BE DUE AND PAYABLE TO THE CITY OF ANNA UNDER SAID AGREEMENT MOTION: Council Member Miller moved to approve. Mayor Pike seconded. Motion carried 5-0. 16. Briefing/Discussion regarding a grant funding opportunity through the Texas Department of Transportation's Safe Routes to School grant program. (Joseph Johnson) The Texas Department of Transportation (TxDOT) has announced an upcoming call for projects for bicycle and pedestrian infrastructure. The Safe Routes to School (SRTS) program is administered by TxDOT and provides funds to design and construct bikeway and pedestrian projects located within 2 miles of K-8 schools. TxDOT has $8.7 million available and City matching funds are not required. Staff intends to submit an application for projects that complete missing sidewalk segments near Anna Middle School and Rattan Elementary. Preliminary project applications are due in April 2019 to determine eligibility, followed by a detailed application due in August 2019 for eligible projects. No action, discussion only. 17. Consider/Discuss/Action on a Resolution approving the placement of a Statue in Sherley Heritage Park of Collin McKinney. Collin McKinney, one of five persons to pen the Declaration of Independence of Texas from Mexico homestead was in the area currently known as Northpointe Crossing in Anna. A historical marker currently exists at the northeast corner of McKinney Street and Collin Street. Collin McKinney is also the name sake for Collin County and the City of McKinney. The proposed Resolution would approve locating a 9' statue on a 3' base in Sherley Heritage Park to commemorate part of the rich history of Anna. The statue would be paid for using donated private funds. The base would use local funding.
