November 25, 2008 6:30 p.m. —Anna City Hall Administration Building
The City Council of the City of Anna will meet in Workshop Session and Closed Session
at 6:30 p.m., Tuesday, November 25, 2008, at the Anna City Hall Administration
Building, located at 111 North Powell Parkway (Hwy 5), regarding the following items.
1. Call to Order
2. Roll Call and Establishment of Quorum.
3. Discussion of proposed Smoking Regulations. (Philip Sanders)
4. Discussion regarding re -zoning certain properties. (Maurice Schwanke)
5. CLOSED SESSION: Under Tex. Gov't Code Chapter 551, the City Council
may enter into closed session to:
a. discuss or deliberate the purchase, exchange, lease, or value of real
property (Tex. Gov't Code §551.072);
b. consult with legal counsel on matters in which the duty of the attomey to
the governmental body under the Texas Disciplinary Rules of
Professional Conduct of the State Bar of Texas clearly conflicts with
Chapter 551 of the Government Code (Tex. Gov't Code §551.071);
c. Discuss or deliberate Economic Development Negotiations:
(1) To discuss or deliberate regarding commercial or financial
information that the City Council has received from a business prospect
that the City Council seeks to have locate, stay, or expand in or near the
territory of the City of Anna and with which the City Council is
conducting economic development negotiations; or
(2) To deliberate the offer of a financial or other incentive to a business
prospect described by subdivision (1). (Tex. Gov't Code §551.087)

AGENDA SUBJECT: Discussion of proposed Smoking Regulations.
SUMMARY: I have received requests from Council members to see on a Council
agenda an ordinance that restricts smokingin locations to which the public has access.
The attached draft is very similar to the restrictions that were adopted by the City of
McKinney. After the Council discussion, we will make any necessary revisions to best
reflect the majority opinion of the Council.

The City Council of the City of Anna will meet in Regular Session at 7:30 p.m., Tuesday,
November 25, 2008, at the Anna City Hail Administration Building, located at 111 North

Howard & Company, P.C. as the CPA fine to provide financial and compliance

authorize the City Manager to execute an agreement with the firm to provide

AGENDA SUBJECT: Discuss/Action on Recommendation of selection of Pingleton,
Howard & Company, P.C. as the CPA firm to provide financial and compliance audit
services for the City of Anna for the 2007/2008 Budget Year and authorize the City
Manager to execute an agreement with the firm to provide the services.
SUMMARY: The City Staff contacted several cities in the area to locate frons providing
municipal audits including Fairview, Prosper, Melissa, Celina, Royce City, and
Princeton. We also ask about the overall satisfaction from the experience with the audit.
We chose three recommended auditors and ask them to provide us information on their
firm. Pattillo, Brown & Hill, L.L.P in Hillsboro was not able to provide auditing services
in the time period we needed to receive the Audit. We also contacted Scott, Singleton,
Fincher & Company from Greenville and Pingleton, Howard & Company, P.0 from
Frisco. We had meetings with representatives from both firms and discussed procedures,
timing for the audit, providing assistance to improve the financial system of the City and
other matters. We also received a proposal from Gregg & Company to provide services.
After discussions with our attorney we believe the City Charter prohibits the use of Gregg
& Company because of the number of consecutive audits from the firm.
STAFF RECOMMENDATION: Considering the information provided by the two
finalists, after the interviews with the two companies, and the recommendations from
three of the Cities we talked to, the City Staff recommends the City engage the services
of Pingleton Howard & Company, P.C... Mr. Tom W. Pingleton, CPA will be at the
meeting to answer any questions you may have. Mr. Pingleton is prepared to start on the
audit as soon as their firm is approved.

AGENDA SUBJECT: Consider/Discuss/Action regarding adopting an ordinance naming
the Anna Code of Ordinance.
SUMMARY:
This ordinance amends the City's codification of ordinances to provide a uniform citation
to the codification, as well as uniform ways in which the title of the codification may be
abbreviated. Such uniformity is required by the City Charter and will assist in maintaining
an orderly system of citation to the codified ordinances when cited in legal documents and
public documents of record..
RECOMMENDED ACTION:
Adopt recommended ordinance.
